Montesquieu lives in Honduras

The events in Honduras are the most faithful reflection of the meaning of the principle of separation and autonomy of the Public Authorities, which in turn was developed by the famous Baron de Montesquieu in his immortal work "The Spirit of Laws" published in 1748; in which this principle is considered as a guarantee against despotism.

In the case of Honduras, its Constitution is shielded against the claims of eternización in power precisely because of the numerous coups and military dictatorships which crossed the Central American country.

The Honduran Constitution is America's most fierce in the fight against autocracy and aspirations of totalitarian rulers. That is why in its article 4 stipulates that "the alternation in the presidency of the Republic is mandatory" and "Violation of this rule constitutes the crime of treason against the fatherland."

Article 239 confirms the principle of alternation in saying: Article 239: "The citizen who has ownership of the executive branch may not be President or Designee.

Anyone who violates this provision or the proposed reform, and support those who directly or indirectly, immediately cease the discharge of their duties, and shall be disqualified for ten years to exercise any public function. "

Similarly, Article 272 states that the Armed Forces of Honduras are formed to maintain and uphold the rule of the Constitution and the principle of alternation in the presidency of the Republic, among other things. As if this were not enough, Article 323 is emphatic when it states as follows: Article 323: "The officials are the depositaries of authority, legally responsible for their official conduct, subject to the law and never above it. No officer or employee, civilian or military, are obliged to follow orders that are illegal or involve the commission of crime. "

And he concludes, prohibiting section 374, the reform of article 373 and articles that refer to constitutional form of government, the national territory, the presidential term, the ban to be new President of the Republic, the citizen who played under any title and on those who can not be President of the Republic for the subsequent period.

Thus, former President Manuel Zelaya, who then took a turn to the left populist ideology, tried to propose a Constitutional Assembly to establish the indefinite re-election as it was unconstitutionally in Venezuela; action supervised and directed by Hugo Chávez and Cuban castrocomunismo.

Zelaya led a popular consultation in order to pave the way to realize their hegemonic pretensions of power. Consultation which had been declared illegal by the judiciary and was rejected by the electoral body, by Congress, the Attorney General, the Prosecutor, by political parties, including the party of former President, the Armed Forces for the Church and by the people, according to opinion polls.

But Zelaya tried to be above the Constitution and the law to ignore the electoral and judicial decisions and try to carry out its consultation illegal, even lashing out against the Air Force installations where the election materials.

By doing this, the former President Zelaya incurred charges of treason to the homeland, in accordance with Article 4 of the Constitution and continues in office for 10 years being disqualified for the exercise of public function.

Therefore, other public authorities were left with no alternative but to implement in full extent the Constitution and arrest of Honduras under Zelaya repeated and flagrant violations of the Constitution, for which the Armed Forces to use their powers and fulfilling its constitutional duty proceeded to expel the country, not being benevolent to leave prison as a prisoner in it.

Congress then appointed as the new Roberto Micheletti Chairman, in accordance with Article 242 of the Constitution, with the unanimous support of all parties are represented, including the party of Zelaya and the institutional support of all the powers and the Armed Forces.

Honduras showed the world that it is a country democratically mature and serious and that its institutions are equipped with a great dignity, bravery and courage and know very well the meaning of the principle of separation of powers proclaimed by Montesquieu.

With this explanation dismantle the falsehoods and manipulation of mental eunuchs who have tried to show this as a coup and not as what it really was: the full implementation of the Constitution of Honduras and the materialization of the system of checks and balances of powers. Therefore ¡Montesquieu now living in Honduras!

I hear Obama this morning saying that we support Democracy and that if the people elect someone we disagree with such as in Honduras, we respect the will of the people. What he didn’t say is we should respect the right of the people to arrest the person they elected if he breaks the law.

The reason Obama supports what Zelaya is trying to do to his nation, IS BECAUSE OBAMA WANTS TO DO THE SAME TO THE UNITED STATES AND SOLIDIFY HIS OWN DICTATORIAL POWER. Just you watch, if he gets reelected in 2012, there will be some kind of effort, arising from the American turbas in the streets, to ammend the US Constitution to add more terms to the Presidency. Saw it here first. This is the Hugo template and all dicatators, be they left or right, want it for THEIR country.

Fantastic article.

In the past, when we think of representative government in Central America, the knee-jerk response is to think of Costa Rica. Now, a new paradigm has emerged. There’s no little resemblance between Honduras now and Massachusetts, circa 1775; two small entities willing and determined to fight great powers for their basic freedoms. A lot is riding on those brave people down there-it’s heart-breaking to see our indifference. THEY are our spiritual brethren-not the clowns in DC.

Thanks, don-o. Zelaya is to meet with Clinton/State Department today. According to this release, Honduran Congressional, Business Leaders to Hold Washington, D.C., Press Conference, Congressional members and business types will hold a press conference at the National Press Club this afternoon at 3 pm. I'm assuming it's still a go. I don't know if it will get much coverage with the whole Jackson thing on today, but at least they're trying.

This is an elegant comparison. It raises another of Montesquieu’s theories that Honduras at first seems to contradict, his climate theory, also outlined in Spirit of the Laws. He believed that geography and climate, that is temperature, rainfall, etc. influence people and their societies, and that certain climates produced particular forms of government. Living in a warm climate supposedly makes people volatile, driven by emotion and more likely to create despotic governments than those living in moderate or cold climates. He wrote, however, that such influences and tendencies can be overcome, and apparently the Hondurans have achieved that.
