Jackson's Will: Diana Ross 'May Be' Guardian

Michael Jackson's will has been filed in an LA court and names Motown legend Diana Ross as a potential guardian for his three children.

The late King of Pop's last will and testament, dated July 7, 2002, says Ross should take custody of his children if his mother is unable to.

Jackson's mother Katherine, 79, currently has temporary custody of Prince Michael, 12, Paris, 11, and Prince Michael II, 7.

"If any of my children are minors at the time of my death, I nominate my mother, Katherine Jackson as guardian," Jackson said in the document.

He then said that if she died before him or was incapacitated, Ross, 65, should get full custody.

"If Katherine Jackson fails to survive me, or is unable or unwilling to act as guardian, I nominate Diana Ross as guardian," he wrote.

Jackson's final wishes also completely cut out his ex-wife Debbie Rowe - mother of his two eldest children - from inheriting anything.

"I have intentionally omitted to provide my former wife, Deborah Jean Rowe Jackson," wrote Jackson.

I’ll bet Diana Ross, 65, is thrilled at the prospect of raising 3 young kids when Katherine Jackson, 79, is unable.

Jackson’s will is five pages long and he left everything to his estate with his mother as administrator.

The five-page document, dated July 7, 2002, gives the entire estate to the trustees of a family trust, and names his mother, Katherine Jackson, as legal guardian of his three children and beneficiary of the trust. If she were incapacitated or died, then the singer Diana Ross was to get custody of Mr. Jackson’s children.

Mrs. Jackson had made it known days ago that she wanted control of her son’s finances. Her lawyer, Burt Levitch, filed papers in Los Angeles court on Monday requesting that she be given control of Mr. Jackson’s financial accounts, his real estate holdings and his stake in the Sony/ATV Music Publishing catalog, which includes works of the Beatles.

In the filing, Mr. Levitch acknowledged several wills might be found.

“It is possible that the court will have to review many wills and evaluate the competing claims of presenters of such wills,” he wrote.

Mr. Jackson named attorney John Branca and longtime friend John McClain as executors. A third person, Barry Siegel, was listed as a co-executor in the will, but the filing said that Mr. Siegel had resigned from the position in 2003.
