Martin Luther King can rest easy. His dream is being protected by the Supreme Court - against and over the opinion of Supreme Court nominee Judge Sonia Sotomayor.
The high court's landmark decision in Ricci v. DeStefano, the New Haven, Conn., firefighters case, is a dramatic stride toward the cherished goal of achieving a colorblind society. In Ricci, the court told us that people of ability can succeed regardless of skin color, and government bureaucrats seeking racially biased outcomes can be thwarted in their racist designs.

I read the opinion, it’s a snake pit.
It was very well discussed that the City had done it’s level best to come up with criteria and a test that would be race-neutral. And they did, in fact, accomplish that result, as a very high level DHS official (who is black) reviewed the test and said all was in order, and the contents were necessary things for a leader in the firefighting field to know.
So the City set the rules, and there was NO OBVIOUS CLAIM THAT COULD BE MADE THAT THE TEST ITSELD WAS DISCRIMINATORY, then, because the City didn’t like the results (well, that’s another story, because there were obvious threats made against them if they didn’t toss the test), the test was thrown out. Solely on the fact that whites had outperformed minorities on all aspects.
Ginsburgs dissent was so weak, I’m surprised it was ever put to paper. It amounted to repeatedly saying “Well, the minorities didn’t score as well, so it must be the Cities and the tests fault”. She patently refused to believe it was either the amount of effort put in to it by the minority participants or any kind of racially based disparity in abilities which may or may not exist.
The net result is this is a stepping stone towards the Civi Rights act being repealed or amended. Drastically amended.

I read the opinion too ... ya shoulda added in parentheses after “amount of effort” (or lack thereof) ...
It’s also interesting and kind of telling that usually, when you have a case this close, more than one of the justices on the losing side join in the dissent.
But the other ones were silent. They couldn’t come up with anything about the facts or the law to oppose the finding.

Sotomayor and the Ricci decision are like bacon and eggs for Obama, this is exactly what he wanted and what he planned. That your children may study and work hard, yet if the outcome is not of a politically correct racial designation then they will be put to the curb and thrown out with the trash. These firefighters studied their eyes out, and worked like dogs to pass the “racially approved” test and the ease and arrogance at which Sotomayor spit in their faces and canceled their dreams of advancement is beyond our belief in America as a nation of justice and fairness. What happened to hard work brings a worker a better life - not in Obama-Soto world, well, not if you are white firefighter who studies hard to pass a test.
The Sotomayor Ricci decision is the synecdoche of the Obama administration. This is what he unabashedly brings to the nation, and doesn’t bat an eye. Obama and his ilk will practice vicious reverse discrimination and place their cadres in higher and higher ranks within government who will act the same way and entrench our government with a deep and ugly prejudicial bias. Sotomayor proclaims it and was proud of it until the rest of the nation saw how ugly it really was.
I am glad the SCOTUS rejected her decision, it was unfair, and the the dissent was of such a weak stature that one knew that they really did not believe what they were writing. Liberals can be real hypocrites and phonies, and in fact this is the issue that they can be crushed on in November because over 70% of Americans believe this racial quota system is wrong.
Racism is wrong, period.
Hello Abakumov, My name is Lastsaint, I have a question for you do you read the law and the consitution?
First, is she a racist? YES -- Clearly; and yes, that is getting some press. But even bigger than that (can you imagine?!?) is how often she's been reversed by higher courts.
I saw buried in one article that she's been reversed something like 60% of the time! ANY judge nominated to sit on the Supreme Court who's been reversed that often should be immediately rejected.
Such statistics reek of incompetence.
So what we should collectively be emphasizing (besides her racism), is how often her decisions have been overturned. That's a drum that needs to be beat far and wide.
Everyone on here should bring this fact to the attention of their contacts in the media, members of Congress, friends and family.

Proof that besides being unfair and biased, affirmative action and racial quotas produce an entitlement mentality and mediocrity. Regarding effort - expect less, reward less, get less.
It's a terrible disservice to the people who are being conditioned to expect to be rewarded regardless of the quality of their results / outcome, but it's a much bigger disservice to the people who's lives are on the line under the leadership of incompetents - in this case - the firemen in the station and the public they are supposed to protect.
Remember these words - there will soon come a time where the tests are not designed to be racially unbiased, but they will be designed and optimized to produce the quotas that they deem appropriate. In other words, the tests will be highly biased toward a race in order to promote color over competence.
I fear you are right and hope you are wrong.
