This is why we need to take care of this anchor baby crap! If your mother and/or father are not U.S. citizens, you aren’t either. Saying someone is an American citizen when their parent sneaks across the border to have the baby is just a dumbass idea.

anchor babies were outlawed in 1996.
(hence the dream act to bring back anchor babies)
This is about birthright citizenship.
In this case the baby goes home with mommy. Custody follows the child ala the 1996 law. Immigration lawyers are trying to change that.
Also keep in mind, in order for a child born OUTSIDE the USA to claim birthright citizenship, the US Citizen parent has to have lived INSIDE the USA for 10 years.
