Pharmacy murder suspect Jerome Jay Ersland will ask a state appeals court to block prosecutors from obtaining copies of his military records, his attorney said Wednesday.
Attorney Irven Box unsuccessfully challenged a subpoena for Erslands military records, arguing they were not relevant to the murder charge against his client stemming from the death of a robber in a May 19 robbery attempt.
Oklahoma County District Judge Tammy Bass-LeSure refused to quash the subpoena being sought by prosecutors, but she did agree to allow Box time to appeal her ruling.
The judge echoed some of Boxs concerns about the potentially sensitive information that could be contained in Erslands military records, but she said the case law provided by the parties indicated prosecutors have a right to request those records.

This guy is being totally railroaded. The only people responsible for any loss of life that day were those who chose to carry out an armed robbery. Period, end of story.

Phony war vet, wow, he also claimed he was wounded in a shoot out and wore a bandage on his arm until it was revealed that he was the only one that fired a shot.

Am amazed at the people who would throw a guy into jail for defending himself, when there is no video to corroborate ANYTHING the DA is saying.

Funny I was thinking of the kind of guy that claims to be a war veteran disabled during the war.
That would explain why he put on a phony bandage and claimed to be wounded during the robbery even though the guy with the gun never fired it.

Does the fact that he admits being a phony war vet mean anything to you as far as supporting the fact that he is?
Ersland, 57, has described himself as a disabled Gulf War veteran, but The Oklahoman has learned he left the U.S. Army before the war began.
Ersland left active duty with the Army in February 1989, according to military records. That is more than a year before the first Gulf War began.
Ersland admitted last week he had misrepresented his military service. He said he was a liaison officer for the Air Force during the war.

Red in PA automatically accuses anyone who doesn’t think that the guy should be given a medal and a parade as actively defending the armed robbers. That’s how his mind works. I have never seen anyone here (on any previous thread) supporting the robbers either.

NO VIDEO EXISTS OF THE PERP ON THE FLOOR AND WHAT HE WAS DOING, SO YOU ARE DEFENDING THE ROBBERS.
THERE IS NO VIDEO OF THE PERP ON THE FLOOR! So, if you are taking the word of the DA at face value over the person who was attacked, you are in fact defending the armed robbers no matter how you want to slice it.
