Pharmacy murder suspect Jerome Jay Ersland will ask a state appeals court to block prosecutors from obtaining copies of his military records, his attorney said Wednesday.
Attorney Irven Box unsuccessfully challenged a subpoena for Erslands military records, arguing they were not relevant to the murder charge against his client stemming from the death of a robber in a May 19 robbery attempt.
Oklahoma County District Judge Tammy Bass-LeSure refused to quash the subpoena being sought by prosecutors, but she did agree to allow Box time to appeal her ruling.
The judge echoed some of Boxs concerns about the potentially sensitive information that could be contained in Erslands military records, but she said the case law provided by the parties indicated prosecutors have a right to request those records.

Fool that hasn’t anything to do with the robbers, it doesn’t even mention the robbers, it only refers to the druggist’s murder charge.
What is at issue are the moments on tape; that and that alone. His life story is a complete non-issue, except of course for people like you who will do anything to defend armed robbers.
You said the video doesn’t leave the DA any choice and yet the VIDEO DOES NOT SHOW THE PERP ON THE FLOOR OR WHAT HE WAS DOING.

Black thug with gun comes into pharmacy to rob it. Pharmacist shoots black thug and kills him. If black thug would have never entered pharmacy with gun with intent to rob it, black thug would still be alive. Charge the guy defending himself with murder. What a joke.

He never shot the black thug with the gun, he shot the unarmed one in the head which made sense, but then later he came back into the store, got another pistol and then shot the unconscious, unarmed robber 5 times is what the police say.
You always believe what the DA says? Or what the police say?
If I recall, they got it wrong in the Duke lacrosse case.
Ersland has said he is a veteran who was wounded during the first war in Iraq.
Ersland, 57, has described himself as a disabled Gulf War veteran, but The Oklahoman has learned he left the U.S. Army before the war began.
Ersland left active duty with the Army in February 1989, according to military records. That is more than a year before the first Gulf War began.

That's a nice attempt at a turn around. You are the one trying to say it is so (that some have said he should go to jail for defending himself) and that I should believe you.

The unarmed thug was in the wrong place at the wrong time. He depended on the armed thug to do the dirty work and he got what he deserved. Never bring a knife to a gunfight or in this case, never go unarmed to a gunfight. Dead lasts a long time either way.
More appropriately, never go into a gunfight with an armed robber, or else everyone will assume you are also armed.
I thought prosecutors couldn’t bring up a “criminals” past history. Is that wrong? Or is it OK when prosecuting a white guy for shooting a black thug?
For one thing, AFTER Ersland came back in from his outdoors excursion, he literally stepped over or around the (.380) shot kid -- and turned his back on him while he strolled over to the counter and fiddled around. THEN, he walked over to the kid and finished emptying his .380 into him.
And then, he called the police...
He certainly didn't appear to be threatened by the downed kid...
