Isn't carrying a false passport a federal crime? And doesn't the Yemeni connection put him in CIA jurisdiction?

I hope the families of these amazing soldiers demand to know why this guy wasn't picked up instead of just being "observed".

Acting alone, he is not "levying war," nor is he "adhering to [our] Enemies," nor giving them aid and comfort.

If he was deliberately targeting US soldiers for no reason other than they are soldiers, he's "levying war" on them. If he'd killed them in bar in North Little Rock, that would be one thing, but delibertly went to where they were, and the files on his computer will show that.
