Bush Solicitor General Ted Olson Supporting Same Sex Marriage

President George W. Bush's first Solicitor General, Ted Olson, filed a lawsuit in US district court on May 22 to protest Prop 8, the California law banning same sex marriage.

Joining with his former opponent in Bush v Gore, David Boies, Olson is suing on behalf of two same-sex couples in California, The Advocate reports: Kristin Perry and Sandra Stier of Berkeley, who have been together for nine years and are the parents of four children, and Paul Katami and Jeffrey Zarrillo of Burbank, who have been together for eight years.

Prop 8 isn’t a “law”.
It’s an amendment to the California Constitution.

It’s an amendment to the California Constitution.

Not only that, it would seem yesterday's California Supreme Court ruling pretty much puts the kibosh on this. Their only avenue left would be the US Supreme Court...

At Americablog, gay activist John Aravosis writes in response: "Ted Freaking Olson is now better on gay marriage than our president - than most of our party...At what point will President Obama realize that the year is 2009 and not 1993? ...So why does our president? Why do he and his advisers seem to be treating gay people and their issues as, at best, an embarrassing inconvenience?"

I have no problem with people (and lawyers) fighting for what they believe in.

If he believes that there’s undue discrimination at hand, he should certainly fight it.

But journalists who see (or intentionally posit) Prop 8 as just another law are different.

That's why they filed in Federal Court. This is a big deal. David Boies and Ted Olson are arguably the two finest litigators in the country. They would be a formidable pair any court, and they would be a dream team for any constitutional case.

to post 3 - so he would become destitute if not for his accepting cases like this? For some silly reason I doubt that very much. Where is the line drawn between morality and immorality? Evidently Olsen values money more than righteousness. His choice, but he still sucks.

They are two lesbians who have intentionally deprived four children of a father, and aided some man in shirking his responsibility to his fellow citizens of taking care of the children he fathers.

They’ve pulled Vaughan Walker as their judge. I’ll see if I can pull up some judicial info on him.

Jerry Brown as Attorney General will have to answer the complaint - and we all know where HE stands. They should file a 12(b)(6) motion to dismiss for lack of standing (the definition of marriage is not a federal question - it is left up to the states under the doctrine of enumerated powers to define marriage).

Of course, Jerry’s in a pickle with this one, though - he wants to be governor again and he’s got that whole anti-8 stigma attaching to him. Our TEA parties in California on July 4th should be interesting.

As a conservative who respects the constitution, Ted Olson and the conservative majority of SCOTUS if they over turn this ruling I will respect it. But right now, the legal neophyte I am however, I do not see where this case presents anything new that the federal courts have seen since DOMA relegated to the states the right to define marriage.
