White House wins court fight on e-mail disclosure

WASHINGTON (AP) -- A federal appeals court ruled Tuesday that the office that has records about millions of possibly missing e-mails from the Bush White House does not have to make them public.

The appeals court in Washington ruled that the White House Office of Administration is not subject to the Freedom of Information Act. A group known as Citizens for Responsibility and Ethics in Washington had sued to get documents about the office's electronic record-keeping.

In response to court orders in the case, the White House disclosed that it has located nearly 3,500 pages of documents about problems with its e-mail system. But the Bush administration argued that the office's records are not subject to public disclosure, even though it had responded to hundreds of other FOIA requests in the past decade.

A lower court sided with the Bush administration last June, and Tuesday's opinion upheld that order.

The Clinton Admin had to make public something like 32,000 emails, per court order, IIRC.

I do recall some hearings. I think Northrup Grumman had a contract dealing with the email/computer system. They stumbled upon lots of supposedly "lost" emails that had been subpoenaed but never turned over. They testified before Congress that they were threatened by the WH with jail if they disclosed the existence of the emails.

Went nowhere.

Right. That’s how I remember it. They were *supposed* to turn over these emails but they were “lost”.
