I think that although ND is within the local diocese as a matter of geography, it is owned and operated by a seperate “order” of priests. The Bishop has the authority to order that the sacraments not be given on the campus, but doesn’t have any way of just closing it down.

The “seperate order of priests” is Catholic. Notre Dame was willed to their order by the founder of Notre Dame.
