Consequences matter.
Obama does not have a place to put these people, and Obama does not want to keep them locked up, without a trial, and Obama does not want to look like he is a rubber stamp of the VERY effective Bush policy.
So Obama will tweek it around the edges and say it is different!
Better for Obama to put up with the left wing loons, in his own Party, then for one of these terrorists to be released and kill more Americans.

It was so easy to hurl judgements and criticisms at Bush about The Gitmo prisoners. Whatever he did, they howled! But somehow, now that they have to make the difficult decisions, they decide maybe the way Bush did things wasn't so bad. We'll just leave them the same.
But no recognition of course that Bush was doing the best he could with a difficult situation.
