Convicted Rapist Plans to Return to Fresno

"The now-52-year-old Polk raped a Fresno mother of four, and tried to kill her, first by choking her and then by holding her face over the flames of a gas stove."

This is the type of guy who should never be allowed out of prison. The judge who sentenced him tried his best to give him the maximum time possible, but he had to sentence Polk according to the rules in force in Kaleefornia at the time.

Actually, shouldn't be allowed to breath. I've always said a nation that doesn't protect it's women has no men.

I would make it a point if I lived in Fresno and were related to this mother of 4 to meet this Polk guy in a dark alley to introduce myself to him and welcome him to the community with a whoppin kick azz party.

If the guy was sentenced on felony charges the first time, he should have been made to serve his FULL sentence the second time.

What is going on in California other than the left and the liberals have wrecked a once decent state?

Women are not safe in California.

I don’t know the full details anymore of the sentencing rules and the total time in prison that he had to serve, even with a parole violation. The judge was a solid conservative and he did the best he could. Some time after this guy was sent away, the laws changed. If he did this now, he would be in jail until he died.

The liberation of women is perhaps the biggest reason this guy’s crime is not seen as heinous today as it would have been seen in an earlier age.

I guess I was raised old school. You know women and children first. Europe is a good example of what raising nancy boys does to a culture. The women over there are on their own it seems like when it comes to attacks and rapes.

The best answer I can give is that he had to do a certain amount of time and then he would be eligible for parole. Again, it depends on what the rules were at the time he was sentenced.

Even under the present day three strikes law, if a person gets sentenced to 25 years, he would be eligible for parole before serving the full 25 years.

So was I--most definitely.

But we are no longer in an old school world; I wish we were.

I am sure there are still surviving pockets of small communities where those old standards are still honored--but I do not live in such a place (although I hope to be moving to one soon).

I used to willingly give my seat on the subway to women (and then move to the other end of the car, as I was taught), but I wouldn't any longer--even if I still rode the subway.

It’s up to the parole board at his prison whether or not he gets paroled. I’m going to wing it here and pose the theory that since he has done at least half of his time, that he was eligible for parole according to his sentencing rules. The parole board may have had to follow the guidelines of his original sentencing even if the members disagreed with letting him out.
