Hate Crimes Bill Passes House..No Republicans voted for it

The House of Representatives just passed HR 1913 -- The Local Law Enforcement Hate Crimes Prevention Act of 2009 -- on a vote of 234-190. The bill, which Obama has urged Congress to pass, would extend federal hate crimes laws to cover sexual orientation, gender identity, and disability, as well as race, color, religion, national origin, and sexual orientation.

Not a single Republican voted in favor. 15 Democrats voted against.

In the floor debate before the vote, North Carolina Republican Virginia Foxx called it a "hoax" that Matthew Shepard's killing had anything to do with him being gay.

Ted Kennedy and Olympia Snowe will lead the effort for passage in the Senate later in the year.

Whatever happened to “Equality before the law”?? It has been almost entirely supplanted by “material equality”!! Friedrich Hayek nailed it decades ago.

So called “liberals” have completely abandoned their classical roots. I think it is safe to take the term back, they aren’t even pretending to use it anymore. Mark me down as “far right”/classical liberal, or just liberal.

Unless I am mistaken, these “activites” would be federally protected:

The Hate Crime law, HR-1913, will make 30 sexual orientations federally-protected. The American Psychiatric Association (APA) has published 30 such sexual orientations that, because of Congress’s refusal to define “sexual orientation,” will be protected under this legislation. These 30 orientations are listed in the APA’s Diagnostic and Statistical Manual of Mental Disorders (DSM-IV), which is used by physicians, psychologists, social workers, nurses, and psychiatrists throughout the U.S. It is considered the dictionary of mental disorders. Those 30 sexual orientations include behaviors that are felonies or misdemeanors in most states.

Among those sexual orientations being protected by HR-1913 are these:

Apotemnophilia - sexual arousal associated with the stump(s) of an Amputee
Asphyxophilia - sexual gratification derived from activities that involve oxygen deprivation through hanging, strangulation, or other means
Autogynephilia - the sexual arousal of a man by his own perception of himself as a woman or dressed as a woman
Bisexual - the capacity to feel erotic attraction toward, or to engage in sexual interaction with, both males and females
Coprophilia - sexual arousal associated with feces
Exhibitionism - the act of exposing one’s genitals to an unwilling observer to obtain sexual gratification
Fetishism/Sexual Fetishism - obtaining sexual excitement primarily or exclusively from an inanimate object or a particular part of the body
Frotteurism - approaching an unknown woman from the rear and pressing or rubbing the penis against her buttocks
Heterosexuality - the universal norm of sexuality with those of the opposite sex
Homosexual/Gay/Lesbian - people who form sexual relationships primarily or exclusively with members of their own gender
Gender Identity Disorder - a strong and persistent cross-gender identification, which is the desire to be, or the insistence that one is, or the other sex, “along with” persistent discomfort about one’s assigned sex or a sense of the inappropriateness in the gender role of that sex
Gerontosexuality - distinct preference for sexual relationships primarily or exclusively with an elderly partner
Incest - sex with a sibling or parent
Kleptophilia - obtaining sexual excitement from stealing
Klismaphilia - erotic pleasure derived from enemas
Necrophilia - sexual arousal and/or activity with a corpse
Partialism - A fetish in which a person is sexually attracted to a specific body part exclusive of the person
Pedophilia - Sexual activity with a prepubescent child (generally age 13 years or younger). The individual with pedophilia must be age 16 years or older and at least 5 years older than the child. For individuals in late adolescence with pedophilia, no precise age difference is specified, and clinical judgment must be used; both the sexual maturity of the child and the age difference must be taken into account; the adult may be sexually attracted to opposite sex, same sex, or prefer either
Prostitution - the act or practice of offering sexual stimulation or intercourse for money
Sexual Masochism - obtaining sexual gratification by being subjected to pain or humiliation
Sexual Sadism - the intentional infliction of pain or humiliation on another person in order to achieve sexual excitement
Telephone Scatalogia - sexual arousal associated with making or receiving obscene phone calls
Toucherism - characterized by a strong desire to touch the breast or genitals of an unknown woman without her consent; often occurs in conjunction with other paraphilia
Transgenderism - an umbrella term referring to and/or covering transvestitism, drag queen/king, and transsexualism
Transsexual - a person whose gender identity is different from his or her anatomical gender
Transvestite - a person who is sexually stimulated or gratified by wearing the clothes of the other gender
Transvestic Fetishism - intense sexually arousing fantasies, sexual urges, or behaviors involving cross-dressing
Urophilia - sexual arousal associated with urine
Voyeurism - obtaining sexual arousal by observing people without their consent when they are undressed or engaged in sexual activity
Zoophilia/Bestiality - engaging in sexual activity with animals

To protect a “sexual orientation” under H.R. 1913 - while leaving that term undefined — is to protect this whole range of bizarre sexual behaviors. It is to normalize by federal law what are still considered to be mental disorders (paraphilias) by the American Psychiatric Association.

The defendants were just trying to avoid being executed. They’d say whatever the prosecutor wanted.

Sure they did. You do that when you plea bargain. One of the two took it through a jury trial and there was testimony from several sources that Sheppard was targeted because he was gay.

Which is why BS statement like Foxx's play right into the hands of those who want to portray the GOP as the homophobic party of 'no'. Why not just say that there is no evidence that hate crime legislation reduces crime? Or that trying to legislate thought can be counterproductive and can lead to the very actions you're trying to prevent? Or that hate crime legislation, if it has to exist at all, is better left to state and local government where most of the crimes that may be aggrevated by hatred are most likely to occur? Why go off on fairy tales that make you look like a bigot and a boob? We're our own worst enemy some times.

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

Dems have scratched this one as well.

This is the Wickard Commerce Clause in action. From the congressional findings section of H.R. 1913:

(6) Such violence substantially affects interstate commerce in many ways, including the following:

(A) The movement of members of targeted groups is impeded, and members of such groups are forced to move across State lines to escape the incidence or risk of such violence.

(B) Members of targeted groups are prevented from purchasing goods and services, obtaining or sustaining employment, or participating in other commercial activity.

(C) Perpetrators cross State lines to commit such violence.

(D) Channels, facilities, and instrumentalities of interstate commerce are used to facilitate the commission of such violence.

(E) Such violence is committed using articles that have traveled in interstate commerce.

I heard a lot of preachers and Rabbis were worried about this bill, worried they could not preach against the FDRQ’s in their churches. Did you hear about that?

People worry about a lot of things, but there is nothing in the bill that would punish speech unless accompanied by an otherwise-criminal act.

People charged in criminal cases get a lot of latitude to request evidence.

big Pittsburgh case 25 yrs. ago....a gang of lesbians who played on a softball team together and hung out at a certain bar would pick-up straight guys then take them out to the woods and roll them at gunpoint. They would take their clothes and money and leave them in the woods, go back to the bar and have a good laugh with the other lesbians. None of these guys would report the crime so they did not get caught until they grabbed some visiting Turk who did not understand English, did not follow their commands and they ended up shooting and killing him (both involved are serving life)

No No NO! Opening up every bit of the Constitution in the form of a Constitutional Convention is the worst thing you can do. Doing this ensures every single right afforded to you (actually restricted to the government) is up in the air. Maybe we feel the 2nd Amendment should be “tweaked” to ensure it says militia. And so on...

I call my dog a fag sometimes — (when he does stupid stuff) I don't really think he is a male lesbian, but I can't stop myself - I don't hate him either - he is really a pretty cool dog.

Can I be arrested for this? Would my dog have to press charges or maybe have some proof that I called him a fag like a recording or something.

Back in the day, William F. Buckley did yeoman work restoring the respectability of conservatism by casting out the embarassing hangers-on (conspiracy theory cranks, anti-Semitic rabble-rousers, etc). It's becoming more and more evident that the job needs re-doing, and I don't see any leader on the horizon capable of stepping up to the plate.

This from the bill

“`(A) IN GENERAL- Whoever, whether or not acting under color of law, in any circumstance described in subparagraph (B), willfully causes bodily injury to any person or, through the use of fire, a firearm, or an explosive or incendiary device, attempts to cause bodily injury to any person, because of the actual or perceived religion, national origin, gender, sexual orientation, gender identity, or disability of any person—

`(i) shall be imprisoned not more than 10 years, fined in accordance with this title, or both; and

`(ii) shall be imprisoned for any term of years or for life, fined in accordance with this title, or both, if—

`(I) death results from the offense; or

`(II) the offense includes kidnaping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill.”

and this...

“There are authorized to be appropriated to the Department of Justice, including the Community Relations Service, for fiscal years 2010, 2011, and 2012, such sums as are necessary to increase the number of personnel to prevent and respond to alleged violations of section 249 of title 18, United States Code, as added by section 7 of this Act.”

What this actually means is if you beat the crap out of a pedophile who sexually molested your 10 year daughter, the defense attorney for the pedophile (being paid for by your tax dollars) could apply for a grant under this bill (again paid for by your tax dollars) to attempt to prove:

1) You attacked the pedophile because of his sexual orientation, and

2) You were trying to kill him.

If both elements are proved in court, the defense attorney could ask for you to sentenced to life in prison.

This is the Obama nation; where pedophiles become a protected class. They can't help it, they were born that way, blah, blah, blah...

This is not law yet, but it may sail through the Senate because of the Swine Flu Scare.

Just watch now. All the good old crime dramas (like the Law & Order series) that used to be entertaining but have now turned into politically correct lecturing shows will have a run of hate crime stories.

There will be more "hate crimes" occurring on television shows than in real life ever did.
