SUBJECT: 9th Federal Circuit Court Ruling on Nordyke v. King – Impact to California Law

April 20, 2009 the United States 9th Circuit Court of Appeal rendered its opinion on Nordyke v. King. (http://www.ca9.uscourts.gov/datastore/opinions/2009/04/20/0715763.pdf) As of that date, the 2nd Amendment to the United States Constitution is found to be incorporated against the states, including California, which is within the jurisdiction of the 9th Circuit. The California Department of Justice must now cease and desist from enforcing any and all state legislative enactments which are contrary to Nordyke and Heller v. DC (which found an individual right to keep and bear arms) since they are unconstitutional, and may not in any sense be considered “laws.” The right to keep and bear arms is now an individual right in California, and may no longer be infringed by such laws as the Roberti-Roos Assault Weapons Control Act. Further, the State of California must now disgorge all the illegally collected registration fees associated with said unconstitutional law, returning the monies to those who were forced into paying a fee for their fundamental rights (see also Murdock v. Pennsylvania 319 US 105). Failure to comply with this court ruling makes the State of California, and its agents, liable for prosecution under Title 18, U.S.C., Section 242 - Deprivation of Rights Under Color of Law.

I’ve been waiting a long time to post this letter. Please join me in letting Moonbeam and Arnold know that they’ve got a problem to deal with ASAP. A chunk of their laws are unconstitutional and they need to stop enforcing them NOW!

WOW! does this mean that all the folks on Ebang.com who sell firearms with the disclaimer can not be shipped to California will now have to rewrite their sales pages? COOL!

The right to keep and bear arms is now an individual right in...

Not a lawyer, but I'd rephrase this to say it's always been an individual right and now has been recognized as such.

I sure cannot Imagine that the 9th CIRCUS could possibly get this one SO RIGHT!!!

I’d have wanted to search that courtroom for Medical Marijuana, or...
check the room for either Alan FUNT or Rod SERLING....
