MYFOX NATIONAL) - TMZ reports that Eagles frontman Don Henley is suing a Republican Senate candidate in California for copyright infringement for creating online videos that parody two of Henley's songs, "The Boys of Summer" and "All She Wants to Do Is Dance." State Assembleyman Charles DeVore says the parodies are protected under the First Amendment.
DeVore's parody lyrics attack President Barack Obama and California Senator Barbara Boxer. YouTube initially removed the videos from their site at Henley's request, then added them back at DeVore's and told Henley they would only take them down again if he filed a lawsuit. DeVore also posted the videos on Facebook and other sites.
Part of the lawsuit says, "Henley and ["Boys of Summer" co-writer Mike] Campbell did not, and would not, authorize the use of their song for this purpose," the Contra Costa Times reports . "Viewers might also conclude that Henley and Campbell are political supporters of DeVore, which they are not."
According to CNet , DeVore plans to respond with a counter-claim "asserting our First Amendment right to political free speech." On his Web site, Devore wrote , "That Henley has contributed some $750,000 to Democrats and liberal causes over the years, including $10,000 to Barack Obama and $9,000 to Sen. Barbara Boxer, adds authenticity to the political nature of my ditties. .... Henleys lawsuit shows hes good at dishing it out, but not so good at taking it."
Henley sounds like a pompous idiot.
Looks like Charles DeVore could use some donations. I like his spine ;)
He needs to go get lost in Walden’s Woods.
If he has a lawyer he must have been told you can’t sue over parodies or satires. More stupidity.
Now there’s a guy who’s had a face lift!
Supremes have already ruled that parodies were okay.
if not Paul Shanklin would be in big trouble..
I seem to remember something about “Fair Use”
Mojo Nixon’s great song:
This is the sound of my brain
Then I said -This is the sound of my brain on Don Henley
Then I said -One two three four
He’s a tortured artist
Used to be in the eagles
Now he whines like a wounded beagle
Poet of despair
Puffed up with hot air
He’s serious, pretentious and I just don’t care
Don henley must die
Don’t let him get back together
With Glenn Frey, Don Henley must die
Cut on the TV
And what did I see
This bloated hairy thing winnin’ a grammy
Huah
Best rock vocalist
Compared to what
Bunch of pseudo-serious Kraft angst-a-matic
Satanic plot
Don Henley Must die
Put a sharp stick in his eye, don henley must die
Ya ya ya ya ya ya ya ya
Oh
Quit playin’ that crap
YouÃre out of the band
I’m only kidding, can’t you tell?
I love his sensitve music
Idiot poetry swell
You and your kind
Are killin’ rock and roll
It’s not because youÃre o-l-d
—Cause you ain’t
Got no soul
Don’t be afraid of fun
Loosen up your ponytail
Be wild, young
Free and-a
Get your head
Outta your tail
Don Henley
Must die
DonÃt let him get back together
With Glenn Frey
Don Henley
Must die
Put him in the electric chair
Watch him fry, Don Henley must die
Don Henley must die
Ah ya ya ya ya ya ya ya ya ya ya ya ya ya ya ya
No Eagles reunion
The same goes for you too Sting
Ah
Oh
Time and time again, people have sued over song parodies, and time and time again, they have lost and the courts have said that song parodies are OK.
Of course, if Henley can economically ruin DeVore, that’s how he can win.
What? No “Lying Eyes”?
Don Henley, entertainer, good at what he does but should stick to music. His politics are left wing DEM. I wonder if he would sue the DNC or any DEM using his music? He contributes a bundle of money to DNC and its causes. We did enjoy the Eagles in Orlando earlier this year.
Hope that he loses the suit!
Rest of the Eagles stopped working with him for 18 years cause he’s nuts.
Free advertising for Chuck.
“two live crew” (sp?) settled this at the USSC.
The point is to prove he’s a not a terrorist/right winger.
PR stunt.
Did Diana Ross write the majority opinion?
I wonder how I would feel if Obama starting using a song of mine. (in theory- I don’t really have any songs)
