When Capt. Phillips jumped the first time, he was shot at by the pirates. Why wasn't that considered 'imminent danger'?

It probably was, but the "imminent danger" exception to the "peaceful resolution" had not yet been granted by the Most High Messiah. That came later.

Of course in the normal course of events, it would not have been required. But The One is "different" and his ROE was "peaceful resolution.

Well at least three of the pirates are now peaceful "good pirates".
