Over five months after the election, a three-judge panel has declared Democrat Al Franken the winner of the Minnesota U.S. Senate race.
The judges issued their final ruling late Monday, stating "Franken received the highest number of lawfully cast ballots in the Nov. 4, 2008 general election."
They also have determined that Franken is entitled to receive the certificate of election.
Last week, Republican Norm Coleman suffered a blow after a few hundred previously rejected absentee ballots were opened and counted at the tail end of Coleman's lawsuit contesting his loss in a statewide recount. They broke almost 2-to-1 for Franken to pad his lead to 312.
Outside the courtroom, Coleman attorney Ben Ginsberg minimized the new margin because his side was certain to appeal to the Minnesota Supreme Court.
"What happened today in the sphere of this election is really inconsequential," he said. "There's a much larger universe of ballots that should be opened."
Ginsberg said he hopes the high court would reinstate as many as 4,800 absentee ballots rejected by local officials.
Top Franken attorney Marc Elias said he doubted an appeal would change things.
"The problem that former Senator Coleman has is he lost fair and square," Elias said. "He lost because more people voted for Al Franken than voted for Norm Coleman. No amount of lawyering or sophisticated legal arguments is going to change that."
Secretary of State Mark Ritchie, a Democrat, said he would welcome an appeal, saying he thinks the state's highest court could provide closure.
The appeal must come within 10 days after the final order from the three-judge panel that presided over the seven-week trial.
Hopefull it will stay vacant until the next election... unless Norm wins in court.

Congratulations, Minnesota.
Franken’s election is proof of what a joke ‘Minnie soda’ has become.
I'm pretty sure the dimrats learned how important the office of Secretary of State could be in 2000 from Florida's Katherine Harris. They learned the lesson. We didn't.
Agreed. It is nothing short of disgusting and filled with no respect for himself much less those who voted him in. Of course for the rest of us...we have no respect for him. Low is low is low and this is even lower than a snakes belly. I hope they see the photo everytime they turn around. I wonder actually how many of his constituents have even seen this photo? I wonder if they even know it is out there. Wow...they can have it and him. I wouldn’t touch him with a ten foot pole.
I can't imagine a more bald-faced lie than that. Elias, you sleazeball, we know that Coleman won the optical scan count of the original ballots and won the hand recount as well. It was only after a 'Rat-controlled canvassing board decided which challenged ballots to count and which not to count, and divined votes for Franken that weren't there, that the totals were changed in the 'Rat's favor. The fact is that the only reason Coleman may have "lost" is because of Joe Stalin's maxim: it matters not what the ballots show, it only matters who counts them.
Coleman needs to fight on.
Absolutely. We need to forget about electing congressmen and senators and focus exclusively on Secretary of States. That is where the dims are cleaning our clocks.
This is what we can expect nationwide if Soros is successful in implementing his SoS project in every state of the union.
Something to keep in mind...
Franken - 40% of the vote.
Obama - 52% of the vote.
When it comes to the country as a whole, Minnesota is behind the curve on electing unqualified morons for public office.
As for Ventura, when was the last time YOUR Governor got you a tax-rebate check?
I wouldn't expect the MN Supreme Court (majority 'Rat) to overturn the pro-Franken panel ruling in Coleman's favor, but I think Coleman might have a decent shot in the SCOTUS because of the similarity of the facts in this dispute to those in Bush v. Gore.

‘There’s something rather ironic about that claim.’
It’s a case of psychological projection.
Well there isn’t much they can do. Other than just seat him notwithstanding his lack of a certificate of election.
