CLEVELAND (AP) An Ohio man accused of serving as a Nazi death camp guard asked a U.S. immigration court Thursday to stop his ordered deportation to Germany to face possible trial. A German arrest warrant accuses Ukrainian native John Demjanjuk of 29,000 counts of acting as an accessory to murder at the Sobibor camp in occupied Poland during World War II.
Demjanjuk, who turns 89 on Friday, lives in the Cleveland suburb of Seven Hills.

It is odd. Germany is charging this Russian with German war crimes.
Apparently, they got the camp he guarded confused. They thought he was at Treblinka, while now they think he was at Sorbibor.
I thought this guy was deported last month and the german courts let him go last week.
This guy was already in Israel once before and on trial... what happened?

Gotta have the goods on 'em though. We're SUPPOSED to show them more justice than they show other people. It is 2009, after all.
He was charged in Israel with having been a guard at Camp X. It was revealed, no he was really a guard at Camp Y, not Camp X. So Israel let him go because he was not guilty of the specific crime he had been charged with, but I don’t think he was exactly exonerated..
I’d need good evidence on this guy. He may have been one of the evil ones, however, I had kin on both sides of that conflict. He may have been assigned to that post and didn’t personally harm anyone. If you were drafted into the German army during the Nazi regime, disobeying direct orders was a very good way to be executed within hours. If the Israelis have already had him, and let him go, seems like there is more to the story?
If they can prove he was a guard at ANY concentration camp, then hang him before he croaks.
Much to the embarrassment of the Justice department, he got a fair trial in Israel, and was acquitted. All that effort to subborn perjury and manufacture evidence, and they had to start over. It's taken them about another 20 years to get back to this point.
From your post, it sounds like you may be qualified to work for the justice department.
They have been working on this guy for so long, and they still can’t pin anything on him.
Why don’t they just forget about him and put their resources into investigating Bill Ayres and Bernardine? And if after 20 years or working them over, they haven’t made the case, they should drop it, too.
Nobody knows what really happened with this guy. You should have been there when people, not only Germans, but nationalists of all East European nations were murdering civilians of other ethnic groups en masse, and nobody cares about it any more. And Americans know absolutely nothing about it! It’s the Hollywood version of the Holocaust here!
Yeah and if Germany can’t convict him we got him for JFK, Judge Crater,Jimmy Hoffa, Nicole Simpson and Chandra Levy.
I was just doing some reading on Ted Stevens. Guess what? One of the DOJ attorneys that was held in contempt for failing to turn over documents and thrown off the Stevens case (Patty Stemler) is the same one that was rebuked by a judge in 1992 for failing to disclose evidence in Demjanjuk's case, specifically documents and witness statements that showed he was not Ivan as had been alleged. They really need to purge this scum from the DOJ.
Thanks for that additional info. I’ve worked over the years with a few AUSAs out in the field. The ones that I’ve dealt with have been professional. I’ve not had any interaction with folks at Main Justice, which is probably a good thing.
I used to have a positive opinion. But after following closely 1) the AUSA firings of 2005, 2) the Ramos and Compean prosecution, and 3) the Ted Stevens debacle, my opinion could not be lower. Most of my criticism does point to Main Justice, though. Unfortunately, their behavior stains the whole lot.

Nope, you got the right person. Israel tried him. They didn't convict him and sent him back to the US. I don't know why Germany is after him at this late date, when neither the US nor Israel was able to pin him down.

The Israeli Supreme Court had the Sobibor accusation in the original indictment, it was argued in court, witnesses from Sobibor were brought forward, but no one could identify Demjanjuk as being there, never mind killing 29000.
A lot of lefties dont like this, but its the truth.
Too bad Demjanjuks first lawyer was thrown out a 15 story window and his second lawyer was blinded with acid when he went to the funeral.
The war ended 64 years ago. He’s a senile old man in a wheelchair. Will deporting him send a message to other Nazis thinking about sneaking into the U.S.?
