First Recount Ruling Benefits Franken By Shira Toeplitz Roll Call Staff March 31, 2009, 5:36 p.m. . In another boost to Democrat Al Franken’s case in the ongoing Minnesota Senate recount trial, a three-judge panel ruled Tuesday that only 400 previously rejected absentee ballots will be delivered to the secretary of state to be reviewed.

With a margin of 225 votes separating Franken from Republican Norm Coleman, it’s unlikely that the additional ballots could swing the election in Coleman’s favor. An initial count of the ballots that were ordered to be reviewed showed that 167 of them were from the home counties of the Twin Cities, where Franken had a strong showing.

The pool of ballots is small compared with the approximately 1,350 absentee ballots that Coleman’s campaign wanted added to the final recount tally. What’s more, the three judges explicitly stated that not all 400 will be counted in the final total and instead will merely be reviewed by the court once they acquire more information. The judges ruled that these absentee ballots will be opened, sorted and counted in a courtroom beginning April 7.

The Tuesday decision is the first of what is expected to be several rulings in the recount trial that stemmed from the disputed 2008 Senate race. The ruling is expected to be the first of many that will decide whether Coleman or Franken received more votes in November.

Furthermore, Coleman has indicated that he intends to appeal the result to the state Supreme Court if the three judges do not rule in his favor.

The Senate can legally seat Franken at any time, although Republican leaders have threatened to filibuster any attempt by Democrats to seat him before all of Coleman’s legal options are exhausted.

I’m no fan of Norm Coleman. And if you examine his voting record, he certainly was barely a Republican, and for damned sure not a conservative.

Coleman switched parties out of convenience, not conviction. He knew he was going to lose a primary challenge to Sandy Pappas.

No tears for Coleman from me....and Minnesota and Al Franken deserve each other.

I don’t know what you’re smoking but the quote said car trunks “and such.” There were no “mysterious” ballots in this election.

Either find some evidence that there was any wrongdoing in this election or STFU. I’m not even sure what you’re getting at at this point, but it certainly doesn’t resemble the facts in the matter.

Coleman may not be perfect, but I think he sincerely wants to represent the people of Minnesota. Instead, they (by a razor thin margin) voted to send Al Franken and his big Hollywood ego to Washington. I hope that work out for them.

In the meantime, we can stop whining about this election and act like adults about it.

Amazing, you can win elections and it does not count anymore. It goes to court over and over till the laws change enough for the looser to “win”. Then suddenly it is not an issue.

Blood is going to run in the streets before this is all over. And when our Nation collapses from the rot within our Goobermint, who will feed all the welfare queens and congress critters?

Gee, remember the days when we were a Nation under God? I liked it better, this hopey changie thang ain’t a working so well.

When a high concentration of evil losers occurs, I tend to want to get away from that spot. Sort of like going out golfing with the guys and wanting to step a bit away from some idiot cursing God for their lack of skill in the field. Kinda don't want to be a side causality of a freak accident with lightning out there... As our government gave God his walking papers, the loons are rapidly populating the District of Corruption.

You know, I feel a tingle in the air, like the ozone before a Giant Zot. Perhaps God is concentrating the cesspool before a flush. With Washington DC being such a morass of fools, the Nuclear Iran mismanagement may just solve our problems for us.

At this point a giant smoking hole instead of Washington DC would be good for the country, kinda like a radiation treatment for cancer.

What we need is to really look at what got us to be a great nation, and what it took to make us a new Zimbabwe. A bit of a national apology to God is in order with a serving of humble pie. Beats the sh** sandwich the Goobermint is serving us. God is bigger than Obama and his enablers. God can save us from them.

Even worse than the surrender crowd is the "Coleman deserves to lose to an unhinged marxist because Coleman didn't agree with me 100% of the time" crowd. Talk about cutting off your nose to spit in your face. I don't get it. Coleman was wrong on ANWR, so we'll replace him with someone who's wrong on EVERYTHING?
