The judge didn’t explain in the ruling why Basardh should be let go, but said it was explained during a closed hearing in her courtroom earlier in the day.

The really dangerous issue here is that a FEDERAL JUDGE is determining who and when the Constitution applies to ENEMY COMBATANTS who are NOT U.S. CITIZENS. Which leads to the LONG STANDING logical question — since when do U.S. Constitutional RIGHTS apply to non-U.S. citizens?
I am afraid we are in for a long thrashing and trashing of the Constitution by the Obama-modified judiciary.
And again, where are the Congressional Republicans on these issues?? Where is there voice of LOUD PROTEST and the demands that should be coming from them? WHERE ARE THE REPUBLICANS???? HELLO???

It’s like these judges are competing to see who can screw us the hardest. Habeas corpus has as much place on the battlefield as miranda rights. Guess we have to start collecting evidence in the middle of a war. I would say this is insanity, but I think these facists know exactly what they’re doing, and they’ll stop at nothing to undermine the war effort.

I googled around. She seems to be a mixed bag. On the one hand, she delayed building the border fence because the Sierra Club said the environmental review had been done too fast.
On the other hand, she came out on the right side on a wiretapping case:

I do agree that there seems to be some elementary confusion here, granting citizen rights to enemy captives who are not citizens. Absolutely no one seems to be questioning that. Yet at the same time were are increasingly seeing denial of rights to citizens.

Went from Yemen to join the Taliban, was in a Tora Bora cave with OBL, captured by the Pakistani military. So ... one can guess a closed hearing because some of the evidence was collected by National Security Means and we don't want OBL's minions to know how much we know. This twit of a judge decides this guy is A-OK in her book and we gotta let him go. I can only imagine how she would rule if it was OBL himself. We're screwed. Totally screwed.
