It is hard to feel sympathy for the AIG executive in the picture wearing a Che Guevara shirt, but then I remember the quote,(paraphrased and truncated below).

Mark Levin addressed this on his show the other night. The ex post facto clause has traditionally only been applied to criminal statute. The restriction on bills of attainder would likely not apply if the law was structured for all bailout companies, not just AIG.

Following this thread, it dawned on me that most of the Country is focused on College Basketball games while we are much more interested in keeping track of Congress.
Just an observation.
To: Dan Nunn
The restriction on bills of attainder would likely not apply if the law was structured for all bailout companies, not just AIG. The bill does not target the companies, it targets employees of those companies making a certain amount, the magic $250K. Must be something inherently evil about that number. But it seems to me that the broader issue is whether the law is intended as punishment, in effect is the legislative branch taking on the role of judge, jury and executioner?

The Bill of Attainder Clause was intended not as a narrow, technical (and therefore soon to be outmoded) prohibition, but rather as an implementation of the separation of powers, a general safeguard against legislative exercise of the judicial function or more simply - trial by legislature. U.S. v. Brown, 381 U.S. 437, 440 (1965).
