They were not National Guard but regular Army. The Alabama Govenor when contacted was completely unaware of the situation.

It is
possible that this was just a well-meaning Provost Marshal at Fort Rucker (which is right next door) offering off the cuff to assist the local police. They are probably fishing buddies.
My parents live in a small Georgia town where the police force consists of a chief, a couple of superannuated officers, three squad cars and a paddy wagon. They would need help to handle something like this, and they would probably ask for it.
Also, in an emergency the old adage, "It's better to seek forgiveness than permission" probably applies.

Posse Comitatus is inconvenient, apparently, just as inconvenient as any concept of citizenship, for immigration or for the Presidency.
Nationhood is slowly being stripped away, and with it go Constitutional safeguards.

This in fact did occur, it may have been the result of bad judgement on the part of a local commander but the effect is still chilling.

Umm...posse comitatis, anyone? The governor was unaware?
I seem to recall that the governor has to REQUEST this kind of assistance. We couldn’t even initially send the National Guard into New Orleans during Hurricane Katrina because of Blanco.
