The constitution is the supreme law of the land and can’t even be overridden by the will of the voters without a long process of changing it.

Or a couple of decisions by activist judges at the Fed and SC level.

The voters spoke, but they voted for him under false pretenses! They assumed he was qualified...and may not have voted for him if they had known the truth. That begs the question...and is not an excuse!

So if George Bush won as a write-in candidate, that would have been okay? Bill Clinton? Any two-term president who is termed out? We'd just give them a third term anyway?

What about the clause that lets each chamber of Congress set their own rules? Can we vote to change those rules?

So Martinez is a booger eating moron. By that standard, if a majority of people in the country decided that slavery was good, then it would override the Constitutional amendments that outlawed it.

He ought to be impeached, or a recall should be started. When you’re that stupid, you don’t belong in an elected office. Then again, we’d lose at least 50% of the current crop of congress-critters, starting with Jackson-Lee.

I believe that there is a mechanism.

The wordings of the current oath of enlistment and oath for commissioned officers are as follows:

"I, _____, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; and that I will obey the orders of the President of the United States and the orders of the officers appointed over me, according to regulations and the Uniform Code of Military Justice. So help me God." (Title 10, US Code; Act of 5 May 1960 replacing the wording first adopted in 1789, with amendment effective 5 October 1962).

"I, _____ (SSAN), having been appointed an officer in the Army of the United States, as indicated above in the grade of _____ do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign or domestic, that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservations or purpose of evasion; and that I will well and faithfully discharge the duties of the office upon which I am about to enter; So help me God." (DA Form 71, 1 August 1959, for officers.)

Actually, it is Nancy Pelosi’s fault.

She sent out the Official Certification of Nomination to the Secretary of State in each of the 50 states and sent the name of an unqualified nominee according to the United States Constitution.
