The prosecutor's office is saying additional charges are possible. I wonder if he could be referring to obstruction of justice and/or perjury. From the Seattle P-!:

I bet that it is possible to determine the approximate velocity of that shoe from the video. It looked pretty slow to me. He got a hematoma from the shoe's impact? I don't think so.

The main point is that he hit her twice after she was subdued.
