if he refuses to obey an order from his superiors then he's toast

No, he is not toast -- but he would be subject to court martial under the UCMJ.

That, of course is what he is looking for.

As a defendant in a military court martial he would be in a position to subpoena individuals and DOCUMENTS.

He would have STANDING.
