Gov. Jennifer M. Granholm ''exceeded her legal authority'' when she directed the state Department of Environmental Quality to impose new legal requirements on future coal-fired plants, Attorney General Mike Cox has determined.
State Rep. Kenneth B. Horn, a Frankenmuth Republican, was one of two lawmakers who had asked Cox to issue an opinion on the governor's directive that she announced in her State of the State address this month.
In her announcement, the Democratic governor called for the DEQ to review the need for new coal-fired plants and to explore alternatives before issuing air quality permits. She said the state should set a goal of generating 45 percent of its electricity from renewable sources by 2020.
Consumers Energy delayed construction of a more than $2 billion, 800-megawatt ''clean coal'' power plant near Bay City after the directive, spokesman Jay Jacobs said.
The directive effectively froze the DEQ from issuing air quality permits to coal plants until it reviewed power generating alternatives, he said.
The attorney general's opinion may mean a new coal power plant on the Karn-Weadock site on Saginaw Bay will open in 2015 as originally planned instead in 2017, Jacobs said.
''It will be an interesting twist for us,'' he said. ''Maybe it will give us an opportunity to move (the date) back.''
Horn said he appreciated Granholm's initiative to grow an alternative energy industry that's key to the Great Lakes Bay Region's economy, but he said renewables alone can't meet the area's energy demands.

My daughters both moved out of state: Minneapolis and Philadelphia. They have both said that they never realized how cloudy Michigan was until they moved away. We also figured that it is why we have never thought the weather was bad when we went on our trips to the UK. It makes me wonder what the incidence of melanoma is in the state relative to others.

A bill to amend 2006 PA 110, entitled
“Michigan zoning enabling act,”
(MCL 125.3101 to 125.3702) by adding section 409.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
SEC. 409. (1) A PUBLIC OFFICIAL OR ANY OTHER INDIVIDUAL MAY
RECOVER EITHER TREBLE DAMAGES, COSTS OF THE ACTION, AND REASONABLE
ATTORNEY FEES, OR THE SUM OF $5,000.00, WHICHEVER IS GREATER, IF
ALL OF THE FOLLOWING CONDITIONS ARE MET:
(A) THE INDIVIDUAL IS A DEFENDANT IN A CIVIL ACTION ARISING
FROM THAT INDIVIDUAL'S COMMUNICATION WITH A LOCAL UNIT OF
GOVERNMENT, A PUBLIC OFFICIAL, OR OTHER PERSON.
(B) THE COMMUNICATION UNDER SUBDIVISION (A) WAS IN FURTHERANCE
OF THAT INDIVIDUAL'S CONSTITUTIONAL RIGHT TO PETITION AND OTHERWISE
PARTICIPATE IN THE PROCESS OF GOVERNMENT OR, IF APPLICABLE, IN
FURTHERANCE OF THE EXERCISE OF HIS OR HER POWERS OR DUTIES AS A

(D) THE COURT FINDS BY A PREPONDERANCE OF THE EVIDENCE THAT
THE CIVIL ACTION WAS INITIATED WITH THE PRIMARY PURPOSE OF
HARASSING OR INTIMIDATING THE INDIVIDUAL OR OTHERWISE HINDERING
THAT INDIVIDUAL'S PARTICIPATION IN THE PROCESS OF GOVERNMENT.
(2) SUBSECTION (1) DOES NOT IMPAIR ANY RIGHTS OF THE DEFENDANT
UNDER COMMON OR STATUTORY LAW OR COURT RULE.
(3) AS USED IN THIS SECTION:
(A) “COMMUNICATION” MEANS AN ORAL STATEMENT, WRITING,
ELECTRONIC TRANSMISSION, PHOTOGRAPH, DEPICTION, PEACEFUL
DEMONSTRATION, OR OTHER EXPRESSION.
(B) “PUBLIC OFFICIAL” MEANS ANY OF THE FOLLOWING:
(i) AN INDIVIDUAL WHO IS ELECTED OR APPOINTED TO A PUBLIC
OFFICE OF A LOCAL UNIT OF GOVERNMENT.
(ii) A MEMBER OF A ZONING COMMISSION, OF A ZONING BOARD OR
PLANNING COMMISSION EXERCISING THE POWERS AND DUTIES OF A ZONING
COMMISSION UNDER SECTION 301, OR OF A ZONING BOARD OF APPEALS.
(iii) AN OFFICIAL DESIGNATED IN THE ZONING ORDINANCE TO
ADMINISTER AND ENFORCE THE ZONING ORDINANCE.

Now I live near Pensacola Florida and I love it.

I don’t see how this will get by Mike Cox. We are not allowed to sue government officials but they are allowed to sue us? Na no way. So is Elenheimer a Dem? What was that date again? It is already Saturday 2/21
Energy is being toyed with. We have to have reliable and affordable energy such as nuclear, coal. Renewables are not the answer to our immediate needs.
I moved out of Michigan in 1996 & must say I miss the snow. Of course I’m retired & don’t have to drive on 23 or M-59 on the ice or in a blizzard.
