It would be interesting to hear from fellow Freeper's of cases which have been brought before SCOTUS arguing that Congress has no authority to pass some laws or to take specific action based on the 9th amendment.
It seems this is the least used Amendment in legal circles.

I heard today on conservative talk radio (Rush? Hannity?) that during the depression a number of laws passed by the US Congress were determined by the SCOTUS to be unconstitutional because they were outside the scope of powers dictated to the congress in the constitution. I haven't researched this yet, but it was also mentioned that FDR got pissed when major parts of his "New Deal" got scrubbed. I've put this on my 'to do' list, just as soon as I finish the 'honey do' list ;).
