16 illegals sue Arizona rancher; Claim violation of rights as they crossed his land

An Arizona man who has waged a 10-year campaign to stop a flood of illegal immigrants from crossing his property is being sued by 16 Mexican nationals who accuse him of conspiring to violate their civil rights when he stopped them at gunpoint on his ranch on the U.S.-Mexico border.

His Cross Rail Ranch near Douglas, Ariz., is known by federal and county law enforcement authorities as "the avenue of choice" for immigrants seeking to enter the United States illegally.

Trial continues Monday in the federal lawsuit, which seeks $32 million in actual and punitive damages for civil rights violations, the infliction of emotional distress and other crimes. Also named are Mr. Barnett's wife, Barbara, his brother, Donald, and Larry Dever, sheriff in Cochise County, Ariz., where the Barnetts live. The civil trial is expected to continue until Friday.

The lawsuit is based on a March 7, 2004, incident in a dry wash on the 22,000-acre ranch, when he approached a group of illegal immigrants while carrying a gun and accompanied by a large dog.

Attorneys for the immigrants - five women and 11 men who were trying to cross illegally into the United States - have accused Mr. Barnett of holding the group captive at gunpoint, threatening to turn his dog loose on them and saying he would shoot anyone who tried to escape.

The immigrants are represented at trial by the Mexican American Legal Defense and Educational Fund (MALDEF), which also charged that Sheriff Dever did nothing to prevent Mr. Barnett from holding their clients at "gunpoint, yelling obscenities at them and kicking one of the women."

In the lawsuit, MALDEF said Mr. Barnett approached the group as the immigrants moved through his property, and that he was carrying a pistol and threatening them in English ...

No, this is Communism in action. They know exactly what they are doing. What do you think hate crimes and political correctness is all about? They are designed to silence dissent and sow confusion. That is they way they take over and control a society, at least one of the ways.

Any attorney that takes this case needs to be SHOT, then disbarred....

Sadly that's probably what this rancher should have done to these illegals.

When a man or woman becomes an American, They can pursue the American dream.

An illegal is NOT pursuing any dream ... they are running from law, order, and the legally armed American citizen protecting his investment, his property, his rights , his land, his family, his nation ... and the sorry asses of those that violate his (our) laws.

They're in court and ain't dead, aren't they?

Dead men dumped back on the mexican side sue no one. I just had a friend come back from Juarez... armed federalis everywhere and cobras flying over head armed to the teeth... Americans are told not to leave certain secure economic zones... secured with full auto equipped troops... and the paper has a murder on each page... along with ads for hookers of every sort. This will soon be hussein’s America.

The Arizona borderlands from Naco to New Mexico are a sad reminder of what happens when a nation gives up its sovereignty. The ranchers have been fighting the illegals for much longer than the government has. They have lost cattle, their fences cut, their land trashed, and no one gives a damn == especially John McCain. Many have given up. Their ranches are being turned into ten acre building sites that only a fool would purchase (and there are many Californians who will do so). This lawsuit is just another indication of how “lawyered-up” this nation has become. We do not need more lawyers, we need less law schools.

What happened to the notion of "we are a nation of laws?"

Liberal lawyers and judges. If it weren't for them, lawsuits like this would still be thrown out before the plaintiffs' attorney finished his opening statement, as they were before LBJ's "great society" came into being.

I still think the best tools for border enforcement are Gatling guns and backhoes: Spray and plant on a massive scale.
