They CAN! All you have to do is find a majority with cajones. That's impossible.

I even had a dream awhile back about making a test case and taking it all the way to the SCOTUS. I made them show me chapter and verse in the Constitution that allowed the law they passed( a spending bill about buying something we didn't need). Of course the only thing in the Constitution that says anything vague is it must be for the "general welfare". Everything else is pretty specific. Building a water park in FLA doesn't qualify for "the general welfare". Nevada doesn't want it, I asked.
