There seems to be great deal of misunderstanding on the nature of one of Mr. Berg’s cases that is filed under seal. Perhaps the following website can shed some light http://www.warrenbensonlaw.com/how-it-works.jsp

“The False Claims Act is a law that is designed to reward any person who knows that an individual or company has financially defrauded the federal government, by allowing that whistleblower to file a “qui tam” lawsuit to recover damages on the government’s behalf. The lawsuit is filed under seal and remains sealed during the investigation.”

I am guessing the case Mr. Berg filed on 11/7/08 is a False Claims Act lawsuit and that is why it is under seal. It is filed in US District Court and not in US Supreme Court.

It sounds good in principle but according to the info above it may not apply to senators, presidents etc.
