Elizabeth Shelton, 21, filed a lawsuit in Houston in December against the truck driver that she accidentally rear-ended in a 2007 crash, while she was intoxicated, and in which her boyfriend was killed. Though she was convicted of manslaughter, she is now suing for $20,000 damage to her Lexus SUV and for "pain and suffering," basing her claim on the fact that the blameless driver she hit was uninsured. In all, her lawsuit names 16 defendants, including insurance companies and banks. Shelton is the daughter of a state court judge. [Houston Chronicle, 12-18-08]

Had the truck driver been obeying the law, then this particular accident would have never happened. Thats not to say that she might not have gotten into a different accident, just not this one.”
This might actually have some merit from a legalistic point of view. But one idea from the Arab world that I find attractive, actually an old idea, was that judges should be the wisest persons available. An Arab court would probably throw this out immediately, and additionally have the attorney who actually submitted this lawsuit and the driver without insurance both whipped.

I'm wondering if, instead of wanting it 'repaired', she maybe wants paid for the loss of it. Not knowing what her insurance policy says, nor what Texas laws allow, but just specualtating, there might have been a clause that allowed non-payment of the vehicle damage claim since she was underage & drunk.

Hmmm... I have had boiling water on me before. I got a burn - but nowhere near a 3rd degree burn. No hospital, and definitely no skin grafts.

Test complete - using a standard food thermometer, I checked the temperature of a freshly brewed cup of coffee from my nifty home coffeemaker. 184 degrees F Yet that snopes discussion claims that coffee is normally served at 130-135? My tap water is warmer than that!

Shelton's boyfriend, Matthew McNiese, 19, was killed instantly in the crash and nearly beheaded.
Witnesses said he was hanging out of the SUV's window before the crash.

By keeping their coffee at 180+ degrees(20 degrees hotter than everybody else) you can't taste just how crappy it is.Should she have expected to be hurt if the coffee spilled on her?
