WASHINGTON – Roland Burris has arrived on Capitol Hill in a steady rainfall and a swarm of television cameras to claim his Senate seat.
[snip]
It still wasn't clear whether 71-year-old former Illinois attorney general would be allowed to take the oath of office for the seat ...
[snip]
Earlier Tuesday, Burris had been in tense negotiations with Senate Sergeant at Arms Terrance Gainer. Once inside the Capitol, he was taken to the secretary of the Senate's office for further discussions.

How to keep him from taking his seat? Firehoses and dogs, Harry. That stuff is your stock in trade, isn’t it?

This really does show that for Reid and others, they actually think the party is the legislative body, not the Senate. I wonder how they would have reacted if a Republican or Independent where nominated.

Please consider for the breaking news sidebar ... I don’t know if this will play out in public or will all take place behind closed doors.

Anyone spotted sheets yet?

If you want to see the brutality that was Democrats around the end of the civil war, the movie is called “The Man Who Came Back”. Not the best movie, but really shows, in screen play form, what happened in the south afterwards.

Something to think about, the KKK did not only go after blacks, they also lynched whites, summarily executed white political opponents and any other white guy who stood in their way of absolute political control. Lynchings were about 50-50 black and white.

The KKK was formed up about 1970 and was the terror wing of the Democrat party. Much like Hamas has a terror wing and a political wing. I wonder who gave them that idea?

If arrogance were the touchstone, I’d say seat him right away! Have you heard this guy demanding his rights as “the junior senator”? What an ego!

Colonel, USAFR

I am not a fan of Burris' politics and from what I've heard of the man, including his mausoleum, I don't think he is the right man to represent the people of Illinois. That said, it isn't my choice and it isn't Harry Reid's choice. Burris was legally appointed by the sitting Governor of Illinois in accordance with the 17th Amendment and Illinois Statutes. The Supreme Court of Illinois has already made a determination that Blago can continue to govern when they refused to act on the AG's suit when SCOI was clearly empowered to remove Blago in accordance with the Illionis Constitution and Statutes.

I strongly believe Burris should be seated as I swore an oath to uphold the Constitution and protect it from all enemies, foreign and domestic. Harry Reid CANNOT act as king and refuse Illinois' choice today and perhaps my state's choice tomorrow. Seat him they must and then the full Senate, acting in accordance with the Constitution, can vote to expel him at their own peril.

See my #8. I must support his rights, his ego notwithstanding, the acceptability of his politics notwithstanding. I believe you must too, Colonel.

The secretary of state (Jessie White) refused to certify Burris, giving Harry a way to not seat him.

I think White, Reid & the others should seat him...now.

I’m in total agreement. Blago could have picked someone much worse. He could have picked someone who was young and energetic who could fight vigorously, for many years defending the seat.

It is nice watching the THUGS fighting amongst themselves. It is like the old days of Chicago, watching the gangland mobsters fighting over territories....did Al Capone ever really die???

If their was a conservative Michael Moore, a documentary entitled “Stewart Smalley and friends go to Washington” would already be under way. Burris and Blago, of course, would have major roles. Reid would be the heavy.

Burris has sooo many legal options but they are going to try a truce first. That is a smart move by his attorneys. Someday he will have a seat there and if he went the sue route immediately it could hurt his standing.

News outlets keep mentioning that there may be “back room deals” being made in order to allow Burris to be seated...

1) Isn’t it “back room deals” that created this entire mess?

2) If the paperwork is not in order, then it isn’t in order- period. Is the back room dealing being done by Harry- or the last signiturer needed for the paperwork?

and just FYI— Burris being black has NOTHING to do with this story, yet they just can’t seem to help themselves trying to dramatize this fiasco with that detail...

It is also clear that this entire event today is staged. LITERALLY staged....since when is “news” the act of filming KNOWN staged events?

Modern Media is a joke....

If you look at the Illinois Statute, the Secretary of State is not required to certify an appointment, only an election. White's refusal is only symbolic in my non-lawyerly opinion. See 10 ILCS 5/25‑8
(10 ILCS 5/25‑8) (from Ch. 46, par. 25‑8)
Sec. 25‑8. When a vacancy shall occur in the office of United States Senator from this state, the Governor shall make temporary appointment to fill such vacancy until the next election of representatives in Congress, at which time such vacancy shall be filled by election, and the senator so elected shall take office as soon thereafter as he shall receive his certificate of election.
(Source: Laws 1943, vol. 2, p. 1.) [emphasis added
Note well that the certificate of election part applies ONLY to the subsequent special election, in this case 2010. There is no other statute that I can find that says the Secretary has to certify the appointment, only to record it. If White refuses to record the appointment, that would be a thin reed (npi) on which to hang a refusal to seat. I'm betting Blago could get a court order demanding compliance with White's required duties. White may not like it, but the most he can do IMHO is resign in protest.

I agree with you on all of this....

but if he doesn’t have his paperwork in order, then he doesn’t have his paperwork right...that is not Harry’s fault...

Isn’t the signature needed someone from Illinoise? And if so— it is a state matter....Harry sould not be seating someone in the US Senate when the State they represent has not “officially” certified him....

If not— then WHO is the signature needed? That is the real issue, I believe...

regardless— what a mess

Excellent points. I suppose Burris’ not making too much of a scene is to avoid giving 2/3 a reason to expel him after all is said and done. Of course, watch him screw it up!
