COLORADO SPRINGS, Colo.Prosecutors are considering whether a Colorado law meant to protect homeowners against intruders applies in the case of a man killed outside a house he thought was his.
The parents of 22-year-old Sean Kennedy said detectives have told them their son, who had been drinking, was shot Sunday night after breaking a window to try to get in through the back door of a house a block away from where he lived.

"It gets murky if the door is broken but not open," he said. Investigators are also likely to consider whether Kennedy was warned before being shot.
While the people at the house called police to report that they believed a burglary was occurring, police have not said how long after the call the shots were fired.
"The time frame will be key," Webster said. "It sounds like they were trying to do the right thing and get law enforcement there."

Now, let's say the kid knocked on the back door and they shot him through the glass. There he is bleeding to death, but they delay trying to figure out how to explain this.
We don't have enough information yet to know that these people didn't lie in some shallow attempt to cover up what really happened.
It's fair to investigate the situation and to hypothesize scenarios here. Failure to do so would be a crime in itself.
Uhm, a 22 year old “kid” who smashes into someones window in the middle of the night is probably in for some bad consequences. Don’t get me wrong. I think it was a horrible and sad thing that happened, but you can’t blame the homeowner for acting to defend his house (assuming the facts support our current understanding of events).
One of the first tests of the Make My Day law in the Colorado SPrings area about 10 or 15 years ago was when a ex-husband went to the front door of his ex-wifes house angry and drunk, pounded and shouted, much like this guy.
The wife grabs a gun, runs upstairs, breaks a screen out of the upstairs window, leans out and shoots him dead on the front stoop.
It was determined to be self defense, and no charges were filed.
We don’t know the whole story yet, but I’m pretty sure this will end with self defense. They’re pretty strong on self defense around here.
He was guilty of the only crime the Universe has absolutely no mercy with. The sentence is always death.
He was stupid.

The hazard here is obviously visiting with your neighbors, or watching a football game. Best not to do either. Just wait at home in the dark, guns drawn, waiting for a passing stranger to knock at the door. Right?
Most likely they have a rational fear of retribution 'cause that's what they'd do if the shoe was on the other foot.
Even though they are going to have to sell their house at a bargain basement price (the Obama Depression combined with the fact someone was killed there) they get off cheap. They saved themselves from the unarmed assault of a guy too drunk to know it wasn't his house.

You’re exactly right, I’ve probably driven by the house. I have reason to drive near that area from time to time, as it is next to an industrial/commercial area.
The houses are similar, but each lot and house has grown unique over the past 50 years.

There is not a shred of evidence listed to support the scenario that you have created. It was detectives that told the parents that the 22 year old, who was tragically killed, who had broken the window. Why would they make that up. It is not hard to determine if a window was broken from the inside by a shot or from the outside. It is hard to construct physical evidence to conform with lies about a crime scene on extremely short notice. The police were already called by the time the shooting occurred.

Sure. Don’t you? Particularly when you are breaking into your own home.
