Once Congress counts the electoral votes its basically over. Its the job of the Congress to vet the president when the votes are tallied, after that he is considered qualified. SC will toss this out along with Bergs 9/11 Truther lawsuit. Generally speaking, if your case is not even heard in any of the lower courts, its kind of stupid to keep appealing the case to SC.
I’d really like to agree with you, noob.
But then we’d both be wrong.
“Once Congress counts the electoral votes its basically over. Its the job of the Congress to vet the president when the votes are tallied, after that he is considered qualified.”
U.S. Constitution, 20th amendment
“Section 3. ... If a President shall not have been chosen before the time fixed for the beginning of his term, or if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified;”
The language of the Constitution suggests that you may be mistaken. Obama isn’t President-elect until Congress counts the votes, but the contstitution suggests that he may be disqualified after that. Exactly how is not stated.
While Mr. Berg’s case is very likely to be lost, he has the gratitude and goodwill of every true supporter of the U.S. Constitution for making the effort he has. Those “conservatives” who mock Berg’s lawsuit because it will probably fail, are in my estimation mired in unproductive cynicism. They offer no constructive alternative; just passively accepting the death of the U.S. Constitution as our governing document.

I realize you hope this issue just goes away so your leader can get his crown, but your post is not even in teh same room as what the process is.
Try reading the constitution.
To attack the Berg but not address the merits of the suit shows your weakness.
At any point if it is determined he can’t serve due to COLB it is over. He is out of office.
Read the law moroon.
Except when what you are appealing is the failure of the lower courts to hear your case.
The Constitution specifies that nobody alive today other than a natural-born citizen may legitimately become President. It does not say that other people may become President if Congress accepts them--it says they are not eligible, period.
Unfortunately, many people who read the Constitution seem to have trouble with the concept of 'is'. If Obama is not a natural-born citizen, then he cannot legitimately become President, regardless of who does or does not acknowledge that he isn't a natural-born citizen. It may be difficult or impossible to prove his illegitimacy, but that does not make him legitimate.
It's not over even then, whether Congress impeaches Obama or not. Let him serve as the asterisk president. Obama will bring down the Dems in Congress with him.
Wrong. That is exactly how cases get to be heard by the SCOTUS.
