He says it is unconstitutional because it deprives gay couples of a fundamental right.

I voted YES on Prop 8 so I guess when we vote for something in this state, it’s meaningless. Hey let’s just throw the whole constitution out the window since it’s meaningless anyway right. Am I living in a cartoon or is my country going down the toilet

Declaring a portion of the Constitution “unconstitutional” would be a judicial nuclear bomb.

Why vote?

How many times have voters been told to suck it up by the black robes as they overturned votes?

More proof, California is governed by idiots.

The Cal Supreme Court could have avoided all this.

Now, they are back in the bullseye again.

Liberals NEVER accept defeat. NEVER. If they lose an election, it’s because they were “cheated.” If they lose a vote like this, well the people were just too stupid to vote on something like this and therefore they shouldn’t have been allowed to vote on it in the first place. Of course, had the vote gone THEIR way, rest assured the “will of the people” would have been juuuuuuuuust fine.

Folks, this is how the left has effected a 40-year coup that is now culminating with their capstone achievement, the installation of an illegitimate president. They never give up, they attack from every angle imaginable, no matter how bizarre.

If we are to ever take back our country, we absolutely must adopt a similar mindset.

If you accept that the wages of sin is death, then it sounds like the fundamental right Brown is attempting to preserve is to die by your own hand. Unfortunately, suicide is also illegal in California.

Poor old MoonBeam just can't win.

Brown’s been given his orders to fight Prop. #8 if he wants the backing he will need to run for Governor again.

Guaranteed that’s why his implied position is now secured in anti prop. #8 manuevering.

Another purchased Democrat.

If the California Supreme Court declares Prop 8 Unconstitutional (or not to have been legally adopted), it will be another step toward the Second Civil War. Once again, Americans will be told their votes are meaningless when contrary to Liberalism. How will Conservatives react to that?

Liberals want to destroy all resistance. While we want to defeat them in elections and referenda, they want to conquer us by any means necessary. It's time for us to wake the Hell up!

Jerry Brown promised an extensive investigation into the abuse of prescription drugs in the Anna Nicole Smith and her son's suspicious deaths. This was a while ago, and I have yet to hear a peep from Jerry Brown even though there evidence was there. Or have I missed it?

Note to Jerry Brown: How about doing something in the Anna Nicole Smith & Son cases?

Isn’t it the Atty General’s job to make sure the propositions aren’t unconstitutional before they go on the ballot?

Moonbeam’s not even eligible to serve as AG. A lot of that going around.

There is no fundamental right to be married.

It takes another person to agree to a marriage.

Life, libert, pursuing happiness, etc., all can be individually realized. Marriage cannot be individually realized.

Listen what this assclown did. Attorney General Jerry Brown tried to stack the deck against the November ballot measure barring same-sex marriage by declaring in his formal ballot description that it “eliminates the right of same-sex couples to marry,”. It was originally written to “define marriage as between a man and a woman.”
ALL people have the same rights. If marriage is defined in the traditional sense the no one loses rights, especially considering that they never had these rights to begin with. I do not have the right to marry my mother, sister, father or dog.

Someone should remind Moonbeam that he may still be just a lawsuit away from being removed from office, since he didn’t meet the legal qualifications to run in the first place. Of course, in a Dem-controlled state it’s unlikely that it would happen, but if enough of a stink was raised, who knows? Unfortunately, the California GOP didn’t have the testosterone to push the issue after the Dem judge postponed hearing their lawsuit until after his fraudulent election.

Atty Gen. Jerry Brown is pandering to the radical gays. It has to do with his bid for Governor in 2010 and nothing whatsoever to do with Proposition 8 - which he tried to sabotage and now opposes again.

I don't think many understand how dangerous and insidious Jerry Brown's argument is. He isn't arguing that Prop 8 is a Constitutional Revision. In fact, he conceded in his brief that Prop 8 is a amendment and does not meet the criteria of a revision.

Instead, he is arguing that the will of the California Supreme Court is superior to that of the people. He is claiming that once the unelected judges declare a certain class of people to be a protected class and that their behavior is a "fundamental right" that it can NEVER be amended.

He is literally asking the judges to declare the Constitution Unconstitutional.
