Fair is fair, if the guy swerved into her lane then he’s partially liable for his own injuries, her being drunk or not.

Shelton, her family and the family of the boyfriend who was killed are suing for $20,000 for the destruction of the Lexus SUV she was driving and an undetermined amount for mental anguish, pain and suffering. I'm thinking this is not a very good idea. The 21 year-old dingbat may have no assets and may be "judgement-proof" in civil court, but a counter-suit against her family could bankrupt them.
This is why -- despite the rank dishonesty of it -- it always makes sense to feign an injury at the scene of an accident . . . just in case the other driver is 100% at fault but files a lawsuit like this anyway.

So you are saying a huge truck changes lanes, soon enough to BE in the lane she was in, and THEN she rear ends him?
Still her fault in any court of law not presided over by her father. She was still drunk driving AND the accident was her fault.
