When a petition is thrown out by a SC justice, and is later resubmitted to another judge, the persistent case is usually taken to conference. To say this is a sign of support by Thomas/Scalia is very “kooky” indeed.

If it is so typical to get a case referred toconference, why didn’t these lawyers take their cases to Stevens or Kennedy? Ah, I thought so.
