Good news. Cort is a real hero. He drove all night from CT to DC to make sure the SCOTUS clerks did not foul up his paperwork. Leo said Cort’s case is a better.
In addition to my #51, I’d also like to point out that this is a good example of the difference between libs and conservatives. The conservative almost always distribute urgent requests (such as stay requests) to all the justices to vote on. However, Stevens, Souter, and Ginsburg, while often referring matters to the full Court, do take things into their own hands much more often.
Also, I find it interesting that there was no comment regarding denial of cert (not the same as a dissent) from any of the conservatives. In highly political cases, Justice Stevens often likes to issue such things, pointing out the obvious fact that denial is not a ruling on the merits. I remember him doing this in the highly political issue (and, imo, nonjusticiable) of recess appointments by President Bush.
Again, conservatives have class, libs don’t.

Scalia said he reads the text of the Constitution in a literal manner, a method in which the "plain and ordinary meaning" of the text guides interpretation. "Words mean what they mean."
Yeah, whatever. This is just more of the same. This case will meet the same fate as Donofrio, watch and see.

Nothing will come of it. They’ve already rejected one case.
SCOTUS hates to get invovled in politics—and this would surely be seen to be political. They will defer to the political process. If the Democratic party failed to properly qualify their candidate and the Fed Election Commission wouldn’t act, they are going to leave it alone.
Finally, SCOTUS can read tea leaves as well as anyone else and doesn’t want the country to erupt in riots that would make Watts seem like child’s play.
We should cease all threads on this as useless.

Does it strike anyone else as ironic that the side that’s been screaming for years that Bush and Cheney had shredded the Constitution, now don’t seem to care if THEIR choice for POTUS is Constitutionally eligible?
The whole BC thing is going to die the death of a million yawns. Nothing in the constitution states original birth certificate is required to prove NBC. The whole thing is a waste of time for all involved.
