Court won't review Obama's eligibility to serve By Tim Jones | Tribune correspondent 9:16 AM CST, December 8, 2008 UPDATE: The Supreme Court has turned down an emergency appeal from a New Jersey man who says President-elect Barack Obama is ineligible to be president because he was a British subject at birth. The court did not comment on its order Monday rejecting the call by Leo Donofrio of East Brunswick, N.J., to intervene in the presidential election. Donofrio says that since Obama had dual nationality at birth -- his mother was American and his Kenyan father at the time was a British subject -- he cannot possibly be a "natural born citizen," one of the requirements the Constitution lists for eligibility to be president. Donofrio also contends that two other candidates, Republican John McCain and Socialist Workers candidate Roger Calero, also are not natural-born citizens and thus ineligible to be president. At least one other appeal over Obama's citizenship remains at the court. Philip J. Berg of Lafayette Hill, Pa., argues that Obama was born in Kenya, not Hawaii as Obama says and the Hawaii secretary of state has confirmed. Berg says Obama also may be a citizen of Indonesia, where he lived as a boy. Federal courts in Pennsylvania have dismissed Berg's lawsuit.

No surprise, but I thought John Roberts decides what cases to take and which ones not to. Is this a Roberts problem or is it for this one particular case they voted on it. I am confused on what process was used for this decision. Can a FRiend help???

Needs to be emphasized that Donofrio was not about allegations of foreign birth, but UK citizenship status allegedly inherited from the father.

This means that it is no longer the democrats fault for what is to come.

Blame is and will be placed squarely at the feet of the Supreme Court of the United States.

I would say “God help us”.... but it looks like His response is “I have seen how you (USA) would thank Me”.

Bring your Judgement God... WE DESERVE IT!

I think we should swarm Obama with copies of our birth certificates (I know...stupid idea)....but, I’d LIKE to swarm him with copies of our birth certificates....something is fishy for him to fight this so much...anyone know the statue of limitations on what the Hawaiian governor did (sequestering his BC)???

Well..., it’s like I’ve been saying before about the Supreme Court taking this up, about Obama being a “natural-born Kenyan” and not being qualified as President of the United States. The Supreme Court is not interested in resolving this issue right now — but — they probably will resolve it after Obama has served his term in office... LOL..

So much for the Constitution these days...

I didn’t expect much from the Donofrio case anyway. I believe others have more merrit. As Extremely Extreme Extremist pointed out in another thread. New cases will arise again and again over every bit of legislation he signs.

That title is too expansive; the Supreme Court has merely turned down the Donofrio case, and has not unilaterally declared that it won't review any eligibility case.
