Leo said they do not have to give an opinion with a denial if they do deny the case. He also said that with all the public awareness of this Constitutional issue that if the Justices deny the case he thinks they would give an opinion as to why.

I guess the next question would be that if this citizenship slash birthcertificate issue gets thrown out (with or without reason provided), would that mean that any future lawsuits based on this and resulting from legislation that he signs could also be thrown out?
