See my Post #196 ...

I disagree with your claim that Obama's electors would be ruled ineligible. In 1872, Horace Greeley died after the election but before the Electoral College met. His electors were not ruled ineligible. They merely voted for several other Democrats, only one of whom had been on the ballot. If Obama is ruled ineligible there is nothing in the Constitution that prohibits his electors from still casting their votes for him. Or for Biden, or another Democrat. All that can come out of that is the election will go to the House who will pick a Democrat since they control 26 or 27 of the congressional delegations.

The Constitution says if the President-elect fails to qualify the the Vice President-elect assumes the Presidency.

"If, at the time fixed for the beginning of the term of the President, the President elect shall have died, the Vice President elect shall become President. If a President shall not have been chosen before the time fixed for the beginning of his term, or if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified; "

This is A BIT of a different situtation ...

You are speaking of an ELIGIBLE candidate dying BEFORE the EC ...

In this case, I agree - they are free to vote WHOM THEY PLEASE, since they are released from their pledge.

THEIR ELECTION TO THE EC WAS NOT BASED UPON A FRAUD ...

Just might be that when a President-elect dies, it is treated much differently than being ineligible to hold the office of President. Horace Greeley evidently qualified to hold office per the Constitution.
