It would if O was disqualified after the Electoral College votes, because it basically would be the same as if the President-Elect had died before taking office. Another reason it's so important that the Supreme Court act on these cases NOW. We've got 2 weeks left. They may just let it go on past the electoral vote. That way, even if O is disqualified, it would ensure that the party chosen by a majority of the voters (dead, imaginary, ineligible, and otherwise) still took the Office. Now THAT'S scary! No. Biden would become acting President until a new President qualified. US Constitution, Amendment XX, Section 3.
No it would not be the same. The 20th amendment makes a distinction for a Presidential candidate failing to qualify and the death of a such a candidate.
If, at the time fixed for the beginning of the term of the President, the President elect shall have died, the Vice President elect shall become President. If a President shall not have been chosen before the time fixed for the beginning of his term, or if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified; and the Congress may by law provide for the case wherein neither a President elect nor a Vice President elect shall have qualified, declaring who shall then act as President, or the manner in which one who is to act shall be selected, and such person shall act accordingly until a President or Vice President shall have qualified.
