McCain doesn't get to pick anyone. Article XII of the constitution says there are two ballots. One for president and one for VP. Biden won the VP and he's a natural born citizen, in country for 14 years and over 35 years of age (at least physically) so he's the VP. If this thing drags out in SCOTUS, Biden will serve as Acting President until the matter is decided. McCain is the highest vote getter after Barry so, one assumes, he gets the presidency if Barry can't prove he is a citizen. Palin is out at this point. She can run against whomever in 2012.
