Rep. Jerrold Nadler, D-New York and chairman of the House Judiciary Subcommittee on the Constitution, Civil Rights, and Civil Liberties, has authored a resolution demanding that President Bush refrain from issuing pre-emptive pardons of senior officials in his administration during the final 90 days of office.
The resolution, Nadler says, is in response to Bushs widespread abuses of power and potentially criminal transgressions against our Constitution.
The goal, he says, is to prevent undeserved pardons of officials who may have been co-conspirators in the presidents unconstitutional policies, such as torture, illegal surveillance and curtailing of due process for defendants.
This resolution declares that we will not tolerate a last minute attempt by President Bush to shelter his cronies - cronies who may well be guilty of serious criminal offenses - from the full force of the law, says Nadler
Here is the way President Ford phrased it: 'Now, therefore, I, Gerald R. Ford, President of the United States, pursuant to the pardon power conferred upon me by Article II, Section 2, of the Constitution, have granted and by these presents do grant a full, free, and absolute pardon unto Richard Nixon for all offenses against the United States which he, Richard Nixon, has committed or may have committed or taken part in during the period from July (January) 20, 1969, through August 9, 1974'
This 'deal; was never rescinded.

The pardon power is the Presidents alone. Whether it’s a democrat or a republican it doesn’t matter and Nadler can’t do squat about it.

I said if laws were broken. I don’t believe they were. No president or other official should be above the law.
And how, exactly, is that determined if there are not hundreds of dragged-out political witch hunts to, you know, find out "if laws were broken"?
It is the job of LEO to enforce the laws. Obviously this can be done in such a way as to be unfair, and any Obama investigation/prosecution of Bush personnel would probably be exactly that. Especially since what the left wingnuts consider crimes are primarily policy disagreements.
However, your position seems to be that Bush staffers should NOT be punished if they broke the law. This is not a tenable position. In theory, at least, government officials are not above the law.
I seriously doubt that Obama or any other president is really going to pursue such investigations. It is far too obvious that he could be setting himself up for the same in 4 or 8 years. Kings generally object on principle to attacks on kings.
