Leo found out yesterday that his case was set for conference with all nine Justices on Dec. 5, 2008. This was incredible because Souter turned it down and Justice Thomas set it for conference. This almost unheard of. I logged on Leo's web site tonight and Leo thinks it may be fast tracked for emergency review? Any legal beagles out there? This may be huge. The biggest story ever that no one knows about.

As much as I want to know Obama is (or isn’t) able to serve the office, allowing this suit to move forward sets a rather dangerous precedent.

I’m trying to see his blog but it is slow coming up. Maybe too much traffic. Kind of like the scene in the Mel Brooks movie (High Anxiety?) where so many court reporters hit the row of phone booths, so hard, that it all tips over?

I think Leo was trying to say that the clerk for Souter turned down the case and not Souter. That is why Leo was so upset for several days. I think Leo will address that problem later.

Leo noted last night that it's very unique to have his case swatted away by one Justice, but then picked up by another.

Then again, it may have been that the Clerk just decided to ignore it.

Regardless, the fact that Justice Thomas referred it to the full court via Conference means that they MUST rule on the topic of Natural Born Citizen.

As the State Department says in "U.S. Department of State Foreign Affairs Manual Volume 7 - Consular Affairs":

7 FAM 1131.6-2 Eligibility for Presidency (TL:CON-68; 04-01-1998)
a. It has never been determined definitively by a court whether a person who acquired U.S. citizenship by birth abroad to U.S. citizens is a natural born citizen within the meaning of Article II of the Constitution and, therefore, eligible for the Presidency.

b. Section 1, Article II, of the Constitution states, in relevant part that “No Person except a natural born Citizen...shall be eligible for the Office of President;”

c. The Constitution does not define "natural born". The “Act to establish an Uniform Rule of Naturalization”, enacted March 26, 1790, (1 Stat. 103,104) provided that, “...the children of citizens of the United States, that may be born ... out of the limits of the United States, shall be considered as natural born citizens: Provided that the right of citizenship shall not descend to persons whose fathers have never been resident in the United States.”

d. This statute is no longer operative, however, and its formula is not included in modern nationality statutes. In any event, the fact that someone is a natural born citizen pursuant to a statute does not necessarily imply that he or she is such a citizen for Constitutional purposes.

Are you saying that the Donofrio’s case is being voted on by SCOTUS today or sooner than instead of the scheduled date 5th of December?

I also get nothing at the link. It’s possible that the server has been overloaded by curious Freepers and others. It’s also possible that the Obots have taken the site down.

I also noticed that FR had another seizure just about the time that this article was posted. There’s no doubt that Obama spies, like the clinton spies of earlier days, are constantly monitoring this forum. And it could be that they have orders to take it down when certain sensitive things are posted.

What could be more sensitive than this eligibility issue?
