I am awaiting clarification from the Clerk's office at the United States Supreme Court as to whether my stay application has now been accepted in lieu of a more formal full petition for certiorari (and/or mandamus or prohibition). Such a transformation is a rare and significant emergency procedure. It was used in Bush v. Gore, a case I have relied on in my brief.

We do know the case has certainly been "DISTRIBUTED for Conference", a process usually reserved for full petitions of certiorari. Stays are usually dealt with in a different manner. As to a stay application, a single Justice may; a) deny the stay; b) grant the stay; c) refer the stay to the full Court.

That's what I though he was doing...with McCain in his lawsuit. A higher bar though. Argue all the angles.

Lordy, they must be! It was remarkable. My computer started to crash, faltered a bit, the anti-virus software started running, then it crashed again completely. It worked for probably 5 full minutes with a black screen, cursor only showing, then finally rebooted. Very strange, but the “strangest” thing was that the anti-virus software was triggered. Strange Days are, indeed, upon us.

LD acutally purports that John McCain is not a natural born citizen, due to Panama not being stictly an element of the nation of the USA. So, I repeat to any and all:

What does the Constitution require, if both Obama and McCain are disqualified?

What does the SCOTUS have jurisdiction in requiring?

Dems keep their electors? But she was not on the ballot, so I'm confused. I know she and her supporters were loath to give up their votes at the convention. But those were primary votes.

That’s strange. I got an unknown screen popped up on me a few minutes ago and said it was running a virus scan (not my brand). I quickly unplugged the computer to stop it and am now running mine. I think “they” might be nervous about this subject.

BP2 I'm sure LD said on what I THINK was the Monday night Plainsradio show (boy I'm coming in here late and tired) that the 1790 statue was effectually changed in part due to a 1795 statue that dropped the word “natural” from the phrase “natural citizen” to further his point(s)....
now I'm going to have to go back and suggest you do so unless someone's done so further on this thread- I'm just trying to flag immediately upon seeing your post

So Obama has to be at least 200 years old or he is inelgible because his father was a British citizen.

This is claim #1. It is rock solid. The Framers were deathly afraid a English “agent” could become President or any foreigner.

It would be such poetic justice if Obama were to be disqualified, since his modus operandi in the past was to have his opponents disqualified and thrown off ballots due to technicalities.

I think it it would then be up to each state whether or not to disqualify the entire electoral slates in favor of the third-place electoral slate, or to just let them vote for whoever anyway.

If both the big party slates are disqualified nationally, the third-place slates would be certified and Nader would run away with it.

Ralph Nader - 437
Barr - 77
Ron Paul - 12
Chuck Baldwin - 5
(NO VOTE Oklahoma - 7)

But I think it would be up to the states, and many would keep the original electors and many of those may stick with Obama or McCain anyway. It could be a free-for-all where Obama, McCain, Biden, Hillary, Palin, Paul, Nader and Barr all get electoral votes.

Maybe?:

Nader - 104
Obama - 120
Biden - 80
Palin - 90
Hillary - 80
McCain - 28
Barr - 30
Paul - 6

The House would have to choose between the top three *qualified* of those, with one vote per state...
