It is. The people have the right to overrule the Court. Prop. 8 changes nothing that was not law before May 2008. The "retroactivity" problem was created by the Court's own refusal to stay its ruling til after the election. That is now moot anyway.

California did revise its Constitution extensively during the 1960s through the work of a Constitutional Revision Commission. Revisions are more infrequent and rare than amendments.

The lawsuit is one of six cases filed directly in the state high court in San Francisco to challenge the Proposition 8. All six lawsuits contend the measure is a constitutional revision, not an amendment, because it strips a minority group of a fundamental right.

Regarding the claim that gay marriage is a fundamental right, has Reynolds v. United States (1878) been mentioned in conjunction with Prop. 8?

Although I disagree with certain aspects of the Reynolds opinion, given that the USSC decided that polygamy was not a basic right, then gay marriage cannot be considered a basic right as pro-gay groups are advocating.

Same sex marriage is NOT a fundamental right anywhere in the U.S apart from Massachusetts and Connecticut, where it was imposed by the courts. The only reason it hasn't been reversed there is the Democrats have refused to allow people in those states to vote on the issue.

Where are the Supervisors of the counties where Prop 8 passed?? As usual, conservatives are playing nice instead of fighting for their views.

Republicans are next to worthless. Just look at Red Arnold. If conservatives have learned a lesson by now, its that they have to stand up for ourselves, since its clear no one else will.

If the Supreme Court does nullify Proposition 8 on the grounds that it was a revision, that is going to be the end of the matter. No recall drive or non-retention vote will change the situation, because it will be politically impossible to appoint any replacement Justice who wouldn’t vote to uphold the decision.

Just as in Massachusetts, when it comes to gay marriage, people are happy to vote “no” or say they will do so on narrow questions, but when faced with a bigger choice: permitting gay marriage, or electing socially conservative Republicans, they’ll choose to permit gay marriage.

Our mayor, Alan Autry, stood up FOR prop 8 before the election. Darn I wish he weren't term limited out!!
