Schwarzenegger Reiterates Oppositon to Prop 8

When the state legislature twice handed Gov. Arnold Schwarzenegger a bill to legalize marriage equality in California, Schwarzenegger vetoed it both times, saying that it was an issue for the courts to sort out.

Now, following voter approval of Proposition 8, a constitutional amendment that revokes the right for gay and lesbian families to marry, Schwarzenegger is repeating that sentiment.

The governor went on the news program This Week With George Stephanopoulos to say that he opposes the new amendment, but he believes that the state’s Supreme Court--which found state laws barring same-sex families from marriage to be unconstitutional last May--will eventually rule in favor of marriage parity for all families, reported a Nov. 17 article in the Sacramento Bee.

Of course, if you ask him, supposedly the Governator is not in favor of gay marriage. Maybe he should hire a legal advisor to read California Supreme Court decisions to him. Their decision plainly stated: “ABSENT Constitutional provision to the contrary...” and we remedied that with an amendment. I’m sorry you’re gonna have to pick a side before you run for Senate, Arnie, but you’re gonna have to. We’d prefer it, though, if you’d just switch to the Democratic Party and run against Boxer in the primary.

Prop. 8 will likely be overturned by the Supreme Court of California, which will rule that Prop. 8 meets the standards of a constitutional revision, and not merely an amendment. The difference is that amendments address areas of law and policy that the state constitution does not yet cover, whereas a revision changes something already covered under current law. And, where an amendment only requires a 50% vote, a revision requires passage by the (left-leaning) legislature and 2/3 of the people of California.

Since the courts in California that the rights of gays to marry were already guaranteed under the California Constitution, it will be argued that taking those rights away is a major, substantive change. This group of judges already sees gays as being guaranteed the rights to marry, even though gay marriage was not mentioned in the Constitution; it will not be a stretch for them to rule that this is too significant a change to be a mere amendment and overrule it.

So much for the $40 million Prop. 8 supporters spent getting it past; don't be surprised when gay marriage in California is legal again before Christmas.

Dear Gov. Arnold,

You may be the governor, but your opinion, as expressed in your vote, has no more weight than mine. That’s the way we do it here in the United States.

Now, as a voter, you had your say. That part is over. I know, it was fun being a voter, but now it’s time to go back to being a governor.

As a governor, your job is to stop opining, and enforce the result of the vote.

If you can’t manage to be both a voter and a governor, kindly step aside. There are those who can do both. Sarah Palin, for example.

Sounds like you may be correct. Fortunately AZ is now safe from California gays coming over here and claiming they are "married". Our constitution is now amended so Judges cannot do what your judges did in CA.

Yeah but Ah-nold is trying to find some way to circumvent the people and get this overturned. In other words, the will of the people means nothing. If he does succeed in getting the vote overturned, then we will have become a nation ruled by the courts, not the people.

Sorry, it’s not on the menu. There is no credible militia ready to step in to re-set the Constitution. Militia was the only entity that guaranteed the Constitution, because they were not wielded by the government: they (in theory) came from the people. And we allowed the media to paint them all as extreme radicals.

And even if CA could muster 1,000 determined men with rifles, would they show up? Nay. Americans are too lazy, too apathetic, lack focus, and the next season for “The Contender” is just around the corner.

My prediction: Absent a national revival, and getting back to the Bible, we go quietly in the night. There are too many forces gathering to permit our survival as the republic we once knew. A realigned SCOTUS will seal that deal internally, even if our external enemies don’t.

The courts have been running things since the late ‘80s when million dollar lawsuits over falling in someone’s yard caused my insurance to skyrocket down here in Texas (and they have NOT gone down), so when did it go back to the people?

I did not get that memo!

Unfortunately, a very true statement across the board!

But, they will take my rights from me when they take my guns from my cold dead hands! The problem is like in Ah-nold’s “Running Man” movie - the media will make me out to be some nutcase and the government swooped in at the last minute before I was planning on blowing up half of America!

And the sheeple will go back to grazing at the trough of “American Idol!”
