San Francisco, CA (AP) -- More than one-third of California's lawmakers added their voices Monday to the chorus calling on the state's highest court to overturn the prohibition on same-sex marriage approved by voters last week.
Forty-four members of the California Legislature filed a friend-of-the-court brief in support one of the three lawsuits seeking to invalidate Proposition 8. The case, brought on behalf of gay couples who have not yet married, argues the ban should be tossed out because voters did not have the authority to make such a dramatic change in state law.
The brief argues that the gay marriage ban improperly usurped the state Supreme Court's duty to protect minority groups from discrimination. Proposition 8 overturned the court's May decision that legalized same-sex marriage.
Senate President Pro Tempore Don Perata and Assembly Speaker Karen Bass are among the signers.

They have an agenda.
Yeah! Who do the voters think they are?
“The case, brought on behalf of gay couples who have not yet married, argues the ban should be tossed out because voters did not have the authority to make such a dramatic change in state law.”
Ah, yes they do. This is the United States, last time I checked?
thats simply amazing, this isn’t gonna end well
Would not surprise me if the CA Supremes tossed prop 8.
If the CA GOP has half a brain, they would immediately come out in favor of Prop 8 and use it to gain in traditional rat strongholds in the cities.
They are going against the will of the people, God fearing people at that.
We’ll have to see if the CA GOP has balls.
Let’s just not pay our taxes then. If nothing matters anymore, if our input no longer matters, then screw it. Set up about 2 million ‘Ruby Ridges’ out there and let’s see them try to find the personnel to do anything about it.
HOW DARE THOSE DAMN VOTERS HAVE AN OPINION!
Maybe’ it’s time we threw the supreme court out. If they can’t follow the constitution, why can’t they be removed and arrested?
The Log Cabin Club wouldn't like that.
the voters years ago said they did not want homo marriage.
the judges overturned the will of the people and then the judges were asked if they could stay in their decision because of this situation.
Now the people have spoken again and they still want to overturn the election and the people.
Here’s a thought and what is great about this country. They are more than welcome to move to aother state which suits them or they can move out of the country.
Either way live with the law
Whoever bet against me, owes me 10 bucks!/ sarc - I know you wont pay up!
I guess some people gotta give the obligatory cry before a disassembly person rallies to the cause.
Fat Chance
If Californians allow this to happen, then it’s all over..why even have these ballots .. hell..why even have elections anymore.
Um, do We the People who hired you thugs and voted for Yes on 8 have anything to say about this? “And the people also have the right to clean house if those they have elected don’t govern FOR them.”
On your mark ...
In California, The People’s Voice is the Democrats’ garbage.
But Arnold has gone ahead and climbed into bed with the perverts.
So to speak...
Live with the law — vs — ‘we elect people to govern us and if they don’t work for us, out they go.’
Which is it?
Bacterium-sized balls maybe.
