We can tell and show people this till we go blue in the face, it won’t make one iota of a difference to them.

Today’s Society is spoiled, disconnected from reality, and is, IMO, a Society out of control. To them, these kinds of things are movies that play on late night TV.

We just have to find a different way, a better way, one that resonates with them and their way of thinking. Else we are lost for good.

hmmmm...

so much for that pesky little legal document that states that government is the servant of the people and it gets its powers with the permission of the people it governs.

The people spoke, told the government what to do. I am just getting w-a-y over this kind of stuff.

Not true, Jeff. The California Constitution can only be amended if both houses of the California Legislature vote by supermajority to pass an amendment to the people via referendum. Then the people must pass the referendum into law via majority.

Instead the organizers of Proposition 8 set it up as an initiative, and an initiative cannot be used to amend the California Constitution. When this challenge to the initiative hits the state courts, it is an open and shut case to overturn it.

I believe you have misstated and oversimplified the situation here and that it is not an open-and-shut case in either direction. Here's a more robust analysis of the issue:

Someone else said that the only cure for Socialism is to get it. Carter tried it and look at what happened. Now, this was exacerbated by the oil embargo, which we should not forget. Carter also was completely inept when it came to the Iranians. We can’t really expect to get that sort of luck trifecta this time around, but we aren’t dead by any means.

This is why I support OPERATION THRIFT. I know I’ve said it before, but it bears repeating: under no circumstances must BHO get the economy that we gave the Clintons, or the sheep WILL re-elect him. He needs to be a Carter, not a Clinton, and we dare not rely on him to screw up. If we want our country back, we need to fight for it. We all know fellow Conservatives who are also disgusted with the outcome. Spread the word — tighten those belts, pinch those pennies, and where money must be spent, spend it judiciously. The Christmas season is approaching, the brick-and-mortar retailers are all hoping for a good outcome, and guess who they’ll be hiring — lots of minimum-wage Obama supporters. Spread the word — buy online, and it bears repeating, tighten the belts.

Obamanomics needs to crash and burn. Four years from now, people need to be saying to themselves, “what the heck were we thinking? We’re not doing *that* again!”

Thank you for sending me to the Volokh Conspiracy site. It's a fascinating legal conundrum. A "revision" versus an "amendment". How many angels can dance on the head of a legal pin? Volokh managed to make a case for both sides, which is fine because a good lawyer always writes up his adversary's case before he files his own brief.

When you analyze the political consequences, it becomes one where the justices can uphold their previous decision and define Prop 8 as a revision. But if they do, they risk a repeat of 1986 where Bird, Grodin and Reynoso failed their reconfirmation election. (It was one of the rare moments of clarity in California politics.) So politics and the cold logic of the law collide.

It doesn't make my head spin, but it does causes it to rotate a bit.

The attempt being made is to claim that the voters can “amend” the CA constitution, but they may not rip out a fundamental constitutional right which was of course made a right by this same CA Supreme Court. However, if they do, we should remove any justices that vote to overturn in the same manner as was used to remove Chief Justice Rose Bird in 1986. This action should be taken as quickly as possible so that their action will be fresh in the minds of those who voted for Prop. 8.
